When you receive the decision for your claim, the letter will give reasons for any award, how they came to their decision etc whether it is good or bad news.

Only then can you go forward if your claim is unsuccessful as they give you 1 month to respond to their decision if you believe it is the wrong decision and give your reasons why.

if you ask for a more detailed reason, (statement of reasons) you get an extra 14 days to respond.

I've not read the whole thread so I apologise if this has already been posted but the DWP medical guidance for DLA decision makers lists information about conditions including information on evidence collection for each condition. It's available online on the DWP website along side the Disability Handbook
  • I am seriously upset by all of this.

I was turned down recently even though I am wheelchair bound, and can't walk even 10 yards without severe pain and difficulties. I also have a Blue Badge. My GP has given me a letter confirming that I have severe mobility problems, and yet DLA say that my GP says I have no problem with walking 100 yards!!!

However, I have been told to avoid stress for medical reasons, and also have been told that the appeal procedure is very stressful!

I'm running out of appeal time, and feel like giving up - they are certainly not trying to help people that are really in need!
Without causing offence, which is not my intention, it might be that the DM felt that there were certain contradictions in your application, as there are in your post here.

One sentence says "I am wheelchair bound" which in itself tells anyone reading that you cannot walk and another sentence then contadicts that when you say "I cant walk 10 yards without severe pain".

Walking with pain is not the same as not being able to walk at all and perhaps it is information like this that the DM has had trouble understanding.

If your mobility is as severe as you say it is, you ought to definitely appeal.

I can't believe you've been turned down. I too, am in a wheelchair and can't walk at all, but get the highest amount on both components. What have the DWP said as to why you have been turned down?

HRM is also awarded if you receive HRC and have a severe learning disability with behaviour problems.

Thank you for backing me on this, it's important people are 100% certain of facts when posting, and not to post something they don't know for certain, as this causes further stress and confusion to people in need of good factually solid advice, i have found some great advice on here ,but also come across some dire misinformation if you don't know for sure, there are words you can use for stating this, without leading people to believe your 100% sure of the facts of what you have written, ie i'm not sure, i'm not certain etc:)

    firstly to sunnyone;
that is not the case you can also get HRM for mental conditions that involve, being a danger to yourself and others, as listed in DLA's rules, if i can find it, I will post it, as I used it and won my sons appeal with it back, In 2006 he is autistic, and can walk.

This thread is about mobility problems only which is why I ddint mention the criteria for getting DLA for people is reciept of HRC who have severe behavioral difficulties.
  • Actually, the thread is about DLA.

Unless you already recieve HRC you cant be considered for the learning difficulty/behavioural criteria for DLA and you dont get HRC so theres no need to bring it up in answer to this thread, you STILL wont get HRM because you STILL dont fulfil the criteria.

I understand that the criteria for HRM and a blue badge are the same, so how come I have a blue badge but don't qualify for a mobility award?

HRM automatically entitles you to a blue badge; but a blue badge doesn't automatically entitle you to HRM (for example, people who are blind, have severe upper limb disabilities or uncontrollable epilepsy can get a blue badge; but not HRM)

I may be wrong but this certainly comes across as though you are attacking CWTA and if so it is totally uncalled for. What is the problem here?!

We are here to help each other!

Nobody here is qualified to tell another that they don't fulfil the criteria! It is the DM who decides who is eligible for DLA and at what rate.
