Tesco misprice discussion area part 11

  • Xbox console £279.xx plus gotw (the godfather) definitely no discount being given of £20 as promised on the large poster charts for Xbox. Took a photo with camaraphone and held a newspaper up close to poster - this proves the day the poster was on display:p . I went to 6 stores but only two had correct poster suggesting "save £20" and actually had stock of both items, which i bought. Decided not to bother cust services coz each branch only had one console in stock.( no advice necessary thanks, i know what i am doing:D ) I am confident a fresh delivery/stock will be back in few days, wouldn't want them to take the poster down just yet would we :beer: . Will go back then and if stock of console and gotw, will see if discount comes off again - yes i do have more than 1 child in the family :D who me no :p !!!

    OK, did you actually buy the consoles and games in the two stores that had stock? I don't get this "waiting a few days for more stock" business, either. Did you get a refund in both stores, or did you not actually complain about the overcharges yet?

    I never implied they were, but if they take your money, you have accepted their offer to buy their goods and they have to sell you them at the price offered :D

    Edit... A retailer can of course refuse to sell you goods if he knows the offer is incorrect, Tesco choose to sell you goods knowing that the offer is incorrect and then try to intimidate you into believing that you have done something wrong

    By the time you go back, they may have taken the "£20 off" away, and as its illegal to take photos without permission, I would imagine they would not give you any R&R's with that evidence.......

    You haven't actually read the thread, have you? The whole point of this thread is for people who have been overcharged. In other words, they have been sold (offer, acceptance, consideration, Intention To Create Legal Relations = contract formed) a mispriced item. The contract is already in place when the person goes up to the CS desk to complain about being overcharged. The store has already taken the money and sold the goods. Get it? Incidentally, if a retailer has mispriced items on the shelves and his attention is drawn to them, he must either rectify the problem immediately, or remove the items from sale. Tesco repeatedly fails to do this. Trading Standards would be very interested in this.

    Consumer Protection Act - it is an offence to give misleading price indications.

    I never implied they were, but if they take your money, you have accepted their offer to buy their goods and they have to sell you them at the price offered :D

    They have never made you an 'offer to buy their goods', they display goods that are available to buy at a given price, you then make them an offer to buy them. They can then choose whether to accept your offer or not. That is contract law, and that is why they don't have to sell you goods (legally) that they realise are mis-priced.

    Once they take your money they make the contract :wall:

    Edit... by displaying the goods at a set price how are they not making an offer to buy said goods ?
