Without trying to sound like I am taking sides over the issue (I really hope your Son gets back his Ipod), I really dont think there is much can be done legally to apportion the store the responsibility of your Sons missing item, clearly some scrote over heard the commotion and claimed the item as their own, if anyone is to blame for this, it would be the thief. We could say the store should have asked more questions, to assure the item did belong to the the thief, but "legally" they are not in a position to have to, unfortunately it does boil down to the owner to be more careful.
Lets imagine he left the item behind, and someone sat next to him just picked it up and left, or worse, pickpocketed the item from him. Do we blame the store for not being more careful about who enters the shop?
As harsh as it sounds, the burden of blame has to be down to the owner of the item, he could have just as easily left it at a bus stop, we couldnt blame the bus company for it were someone to swipe it. The store did at least go to the trouble of handing it in, and I imagine quite innocently gave it to a member of the public who claimed to have left one behind.
I am sure that there is nothing "legal" that can place the blame for the loss solely on the feet of the store, as they are not under any obligation to look after other peoples items. Else I could just as easily ride my bike into the store and say "I will be back later for it".
I am not saying that he deliberately left it in the store, I am sure the second he realised he rushed back to the store,
On the same token I do not think the store deliberately gave it to someone else, someone handed it in, someone else walked in claiming to have left one behind, it was as much an accident handing it out as it was being left there in the first place, in effect you cannot claim it is the shops fault, without the owner bearing the crust of the blame as the thief in general is for the whole portion.
In a court of law, the burden of care and responsibility is the owners, akin to allowing an unlicensed or uninsured driver to drive your car, regardless of the circumstances the owner takes the brunch.
I hope all goes well for him, but I have to be honest and say I dont think there is much can be done to either claim compensation, or pass the buck.:A:dance:1+1+1=1:dance::A
