    Hi

I received my ban for driving with excess alcohol in breath in Jan this year for 1 year reduced to 9 months apon completion of a drink driving course over here in N.Ireland. I have attended this course and the tutor has said that as far as he is aware I will not be able to get an ESTA. I travel in 5 weeks time from Dublin to Manchester then Orlando with my gf and daughter for 2 weeks.....to say the least I am panicking. I dont want to take a chance and get turned away. Should I just ring the local US Consulate in Belfast?

Take your pick. One says yes, one says no.

DUI falls into the realms of "drug abuser" which is why a lot of immigration lawyers side on No. The CBP site states "A single DUI conviction is not grounds to deny entry into the U.S.", however, it doesn't state you pass the ESTA.

Appears to be I94W according to here

A completed Form I-94W, Nonimmigrant Visa Waiver Arrival/Departure Record (green form), is required from all Visa Waiver Program (VWP) visitors to the United States at land ports of entry.

You don't need an esta for that.
  • Hi

My husband has a conviction for affray from 16 years ago, he was fined for this, does that count as moral turpitude? He also had a conviction for DUI from approx 20 years ago

Would these need to be declared on the ESTA. Any help is greatly appreciated

Neither affray or DUI falls into the realms of moral turpitude. A DUI that long ago doesn't fall into the "drug abuser" category either (even if it did originally, which could be a separate 10 day debate).
  • Thank you so much for your quick reply. I was in a state of panic now I can begin to relax a bit :j
