And believe me they will ''manage your account away'' if you become troublesome.0

I have just put in a claim for bank charges and have just been told by my bank that the 1977 Act does not apply to me because I am a business customer and the regulations and the Act only apply to consumers. Can this be right? As a struggling small business surely I am also a consumer and as entitled to reclaim bank charges as anyone else? Anyone having the same problems? Should I still proceed with my claim?
Hi
I am assuming you bank with Lloyds, I am persuing them for business bank charges, and just yesterday received a letter stating the same as you mention. Write back stating you are claiming under "Common Law", not Consumer Law. They obviously hope we will give up, No chance.
Will let you know what happens next.
NEVER GIVE UP............:j :j :j :T :T0 -

Could somebody please advise?
I have put a claim in against my bank HSBC for charges applied to my business account. The amount claimed was just under £1,900 and included a claim of £800-00 "management" fees. The management fees were incurred over an eight month period at £100/month. The bank has offered to pay me back everthing except the £800-00 management fees. Am I able to claim these fees too? Should I hold out for these or just accept the offer? I'm tempted to accept the offer of £1,100 'ish but want to make sure that in doing so I'm not "throwing away" £800-00.
Many thanks for helping.0 -
hi there,
it's been a while and i'm doing ok with my finances now thanks to all the help i had here! i have just looked at when the decision for the bank charges is set to be announced and it's the end of july!
i claimed from hsbc successfully before the charges were questioned but now would like to claim against barclays and barclaycard. my barclays account was a business account so can i claim on this at all? some of the charges were over a hundred pounds!! and i am also with payplan so will this affect my situation at all??
many thanks for your help in advance.0 -
Business claims cannot rely on consumer laws and therefore are slightly different to personal a/c's. see here:

wow! those letters mean business! i'm a little concerned about asking for fees as a business though... i dont really have the business anymore i just kinda do some websites privatively now. i started out as a business but it didnt really go anywhere and i couldn't pay the loan back etc. so it started defaulting and was being charged hideous amounts for direct debits being returned. i guess that would be different than claiming back as it was a loan? i really dont know...
like i said, i won from hsbc but that was a current account. barclays have taken a lot of money from me though from defaulting. payplan take care of it all now though!
i'm a bit stuck on what i should/can/will do...0 -
