Hi Smasher,
I am just about to file my stay lift application on a business account and I am very interested in what you said about the OFT recently reitterating that business claims are not affected by the OFT test case. I have looked at the OFT test case question and answer session on their website but can't find this. Can you please tell me where I will find the OFT statement clearly stating that business accounts are not affected by the OFT test case.

I am claiming charges made against my business account. The claim includes £800 "Management Fees". Can I claim these back? Has anyone successfully claimed "Management Fees"?

Hello all,
I am new to this and I have been reading everyones threads and I am looking to do the same as Halifax have smacked me £35x4 and as I am a student (already on a tight budget) I cannot afford this. I have got my templates and I shall be writing to them in the morning.
I have a question, if anyone can answer please.. I have a credit card with Barclays aswell and I have had a few charges on that which I think I can get back BUT I was wondering whether I can get interest charges that I have been receiving (£22 or sometimes more per month) on the Barclays card and the interest charges on my overdraft with Halifax bank.
I have no idea on how banks work and I am really stuck.

I am sure that this question has been asked before, but as I unfortunately do not have access to this site except at work - and I really must do some work - can someone advise whether you can claim bank charges against a business account.
I have a claim in with HSBC which has been stayed, but I did have a business account with Lloyds TSB for a number of years with an overdraft facility. However whenever I went over the limit (usually because of late payment of my invoices) I was charged £20 per day until the balance went back under the limit.
Basically, I just want to check if bank charges can be reclaimed from a closed business bank account before I send them a letter.
Any information would be greatly appreciated.

Business accounts are covered by Common Law rather than Consumer Law, so your letters need to be worded slightly differently.
• You cannot claim back your statements using the Data Protection Act, so it can be a more costly process if you have not kept records. However you might be able to use the DPA if you are a sole trader.
• You need to send your letters to your local branch, rather than head office, to ensure that if your claim makes it all the way to court, you can have the hearing in your local area, rather than the bank's.
• If you do win back some of your charges, and you have previously claimed these as a tax deduction against your business, you are required to notify the tax office that your taxable income has changed. Unfortunately, this will result in an increase in your taxable income, but you are required to do this by law.
Apart from these key points, the process is almost exactly the same.
Sole traders should be able to use the DPA to claim back their statements.0 -
Can anyone help? Can I claim business charges in the same way as personal charges? Also as I a few business accounts with the same bank can I issue one summons for the lot or do I have to issue a summons for each account?0

Has anyone tried claiming business account bank charges. We were with Lloyds, but sold our business in 2005, does anyone know if we can still reclaim, as we no longer have the business. Thanks,:j :j :j :T :T0
