Business Account - reclaiming bank charges

We are with lloyds tsb they have refused once saying the account was for business, my husband is self employod sole trader, we sent court letter, they now say as final decicision that they still will not pay because we knew of the charges before they were taken. Im now a bit scared as next step is small claims and what if we loose. Llyods charged us over £4000 so we said pay £3000 but as I said they still refuse,ombudsman not taking on anymore cases ,Help what next
You should depending on the age of the charges either commence proceedings if they are from 2001. However if they are from 2002 or later and you can hold on until we have the first instance decision from the High CourtAs I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
It is my understanding that business accounts are not affected by the OFT test case so you should be able to file a court claim as normal. Btw, we also took Lloyds to court for OH's business account (sole trader), and they paid up in full.Reclaimed thanks to this site:

can i claim for the 'arrangement fees' on my statements, these are £100.00 - £150.00 a time also i have charges on my business account that say 'BUS FOCUS FEE' can i claim for this.

Has anybody tried claiming for excessive charges on a private business account incurred from going slightly overdrawn in the same way as personal accounts?0

I personally havent been charged from my business bank account, but i have read of someone getting around 35k back and he had a business bank account.
The fees for going over drawn and bounced cheques you can but not the fees that you get charged for using the account. I.e. like the 50p per cheque cashed, that sort of thing.
I will try and find the info online and post you the details.I all have learnt is from others on many sites.
Seek legal help if unsure.

Earlier this month, a Norfolk businessman received the largest payout from a bank so far, recovering almost £36,000 in penalty charges from NatWest. Again, his case was settled out of court.

Thanks for the info I realise normal banking charges are OK but these are the same type of charges as the personal account i.e. sending letters for being overdrawn. Tony0

I have successfully claimed for our business account. Used the same template letters as for personal account. Was declined for both claims, passed to FOS and had offers just before the test case announcement.Sent both claims on the same day, passed to FOS on the same day and had offers on the same day!!0 -

Can anyone help with wordings for the commencement of court proceedings. I have looked at the template on the web site but wondered if I need to change anything ref business accounts?
please help as 14 days has expired per my letter to them.
