We are trying to claim back bank charges on a business account that is now inactive, and we have statements dating back 8 years (we haven't had to contact the bank to obtain these). We've sent our 2 initial letters, along with an excel sheet that we found on a website that worked out the costs plus interest, but have received no response from the bank, and are now up to the court stage. Can we still proceed with a court claim for these 8 years charges considering the recent announcements, or can we only claim 6 years worth from the date we take our case to court? Also, if our claim is over £5k, can it still go through the small claims court?

I am in a real dilemma.
I am claimimg £17,000 from Natwest (a Business Account). I have been offered £12,000 but only have until Wednesday to accept (8 week deadline)
I am also running a court claim for which the 14 day acknowledgement of service deadline passed yesterday.
If I file for judgement will it be stayed (and potentially be worthless) or does the test case not affect business accounts and/or can an actual judgement be stayed?
I am tempted to take the bird in the hand option due to the uncertainty of the situaution (terrible timing for me!!)
Can anyone clarify any of these points?0 -
Legally where do I stand when my bank has charged me and then charged me on top of it followed by interest when they have been sending out letters regarding it to a completely different name?
The first I heard about it was via their lawyers who have since sent me a letter which yet again has a name on it which isnt connected to either me or the account name in any way whatsoever.
Also when I asked the branch about the account their reply was it was closed with a £0 balance.
I haven't opened the letter yet so I don't know the ins and outs of what it says.
Any advice is welcome

So sorry for the length of this but I have had to quote their letter as I don't know how to explain what they mean.
I am helping my brother claim charges on his business account with HSBC.
We sent the first letter asking for them to repay all of the charges etc and they sent a very wordy reply which we are unsure of how to reply to.
It says they "are not prepared to consider any claims that include other services you may have previously requested or that were pre agreed and notified to you. This will commonly include money transactions (cheques and credits), facility fees (arrangement, renewal and temporary), stopped cheque charges, acquiring charges and the monthly maintenance charge any of which may have been included in your claim. We will also reject any submitted claim that includes 3rd party fees, usually incurred in the submission of a claim, as these may not be included either now or indeed, at a susequent court submission."
The letter goes on to say that before they can consider our request they must understand precisely to which overdraft charges we refer and if we want to pursue this we need to write to them with a specific breakdown detailing the amounts and dates of the charges in question.
We sent them the original letter from this site with a breakdown of what was itemised on the 6 years of bank statement.
One of the charges that was consistent throughout the bank statements statement was something called Total Charges. They want us to send them a specific breakdown of this charge, detailing the amount as as it comprises a number of various charging components which must be split out and itemised for the purpose of the claim. We have no idea how to do this and the bank say they can give us duplicates of these details but a fee will be required.
Can anyone suggest what our next letter should include as I am baffled by what this means?
