Please help me - Is it possible to claim for charges on my business account?? or is it just personal accounts?

I have tried to claim back default charges from my business account with the Bank of Scotland but have received a letter saying that the the Unfair Terms of Consumer Contracts Regulations do not apply to business accounts.
Is this true? or is it just another big bank excuse.:mad::mad:

Hi,
I too am claiming from BOS on a business acc. This is just a fob off letter, hoping you will go away! The t/c may be different, but according to the Ombudsman ( who is dealing with my claim ) there is no difference between personal and business charges. The BOS tried to tell me that they had decided not to pay out on business accounts. I must say, the Ombudsman laughed when I quoted this. I would carry on, but don't mention t/c. etc. I just put that I thought their charges were unlawful and not proportionate to the banks costs.

Yes, you can claim on business accounts. I received an offer through the FOS today for full settlement of my hubbies business account and our joint account. I claimed in exactly the same way for both accounts.

I apologise first of all if this is in the wrong place.
I have a business bank account which I only used briefly (due to the bank in question taking 3 weeks to send an international payment therefore costing me money) before using another bank.
I have just received a phonecall from their lawyers regarding bank charges I owe them for the fiasco with the international payment. They say they have sent numerous letters to me demanding payment etc however I haven't received one single letter with my company name on it.
It turns out that they have been sending letters to me in plain envelopes without any bank reference on the outside and with a completely different name on it starting with X X T followed by my town name but not my company name.
Now I don't know about anyone else but if I get what appears to be junk mail with a name on it that has nothing to do with me I just bin it.
What can I do regarding this? Is it something I should talk to the bank ombudsman about? The bank in question argue they have done everything right and are refusing to back down. I now have this lawyer threatening court action.

Are business customers denied reclaiming the unfair bank charges? Looked on the what you can claim and it wasn't really clear. Finally had a letter from the bank dated 27th - oddly when this whole thing with the OFT thing came out and bank is effectly saying that the unfair terms in consumer contract regs of 1999 do not apply to business customers. Have contracted the obudsman and had very nice letters saying they are looking into things but it could take a while, should I just cut my lossess?0

have a look in the natwest thread and im prety sure there is someone whos sig lists what they have claimed back, and it includes a business account, it may be simply a case of Consumer contract regs is the wrong thing to go for, it might be simply a case of using business contract regs (they might say the same thing)
or there could be totaly different grounds for doing it, i realy dont know but someone on here does.0 -
