    Hi there all,

Dont know if anyone can help me with this. I purchased a shoe cabinet on Amazon from a company called Luxury Express which came flat packed. When it was put together the plastic runners for the drawers were incredibly weak and ran on plastic pins which were inadequate for the weight of the heavy mirrored drawers. The top drawer would not run on the plastic runners and was dangerous too. Also even the drawers that ran on the plastic runners fell forward and opened even with shoes in them.

I emailed via Amazon to say I wanted either a refund or replacement as the goods were faulty. Luxury Express first said if it had been made up to instructions it would have been fine. Then when I said that it had they said it needed attaching to the wall (something which they did not out in the description only in the instructions which came through with t he goods) and would then be fine. I then emailed back to say that I was hardly going to drill into the wall to attach it when the goods were defective in the first place and again requested refund/replacement. They then emailed back today to say that they would refund and pay for pick up if I unassembled the whole thing. I do have original packaging and order number but it seems ridiculous that I should spend money getting someone to unassemble this item. They said it needs to be in identicle condition as when it was delivered which it obviously wont be as it is flat pack furniture. What are my rights, do I need to dissassemble it as they seems to be making things up as they go along do dissuade me from getting a refund. Any information would be gratefully received.

  • Hi all

I figure DSRs cover buyers pretty much in any instance. Ebay seems to confirm this online, stating that BIN buyers can return within 7 days of receipt with some exceptions ie custom made. Also, as in the case of an item I purchased, the seller's returns policy is "none offered", which I gather I can ignore: pages.ebay.co.uk/safetycentre/keepingebaysafeandbuildingtrust/knowyourrights.html#whatiftheseller

However, I have since browsed other listings that state returns are not accepted. Does this mean the seller can get a slapped hand for posting misleading info, and definitely cannot uphold their policy??

I called ebay and asked: "do DSRs cover all BIN transactions (bar the exceptions) and are buyers entitled to a full refund?" YES
"Can sellers post "none offered" returns policies?" YES
"Wait, what?" It's between you and seller to discuss, you can open a returns case and resolve it.

I'm confused!! I want to buy something that seems to be listed only with "no returns" policies but is that even valid??!
It's an item of clothing, so what if it doesn't fit? I don't want to be stuck with a £20 item (I can't afford to just let that go down the pan).

Anyone else out there know any better? Particularly regarding ebay. Please and thanks! :)

If an item is faulty you can return it to the seller and they should pay return costs but if it doesn't fit, or you don't like it when you get it, then you can ask to return for a refund - if the seller agrees - you can return it and you would pay for the postage and packing.

It's best to ask lots of questions first if the seller hasn't given the info, like measurement of the chest - I always ask for armpit to armpit and then double it! You can ask for waist, hip measurement, ask if the colour IS like the photo etc - anything you can think of.

Some sellers are brilliant others leave a lot lacking. I buy quite a bit on Ebay and have found them very good if something is faulty or if you don't receive an item - often sellers say I get proof of postage, ie the post office stamp a piece of paper to say somethings been sent, but there's no proof you've got it - Ebay will cover you here if you don't get it, open a dispute case and you'll always get a refund - in that way it's excellent.

Happyinflorida, that post you have replied to is over two years old.

    Why have you done that?
  • Hi,

I purchased a Ferroli boiler just short of two years ago which was installed successfully in the garage. Having woke up this morning the heating within the house has now reached 28c with a severe leak in the garage, under the said boiler.

I have called the engineer who installed the device and unfortunately he is working out of the country so unable to attend site, but mentioned ringing Ferroli to discuss.

Having called they have mentioned the manufactures warranty and it states that in order for the warranty to be covered, you must have the boiler serviced on a yearly basis. Unfortunately we were unaware of this however after looking on their warranty page it does state that your statutory rights are not affected...

Surely having paid £2,000 for a combi boiler that is less than 2 years old, I should be covered?

    Any help is appreciated,

    Thanks,
    Dominic

Any rights you have are with whomsoever you paid to supply the boiler, and/or with the installer. (I suspect they are one and the same?)

But did you actually read the title of this thread? (I suspect not, since you also [apparently] didn't read the warranty booklet either). ;)
