Sky should never have installed the dish!

  • Personally if everything the OP is saying is correct then I think Sky should do the decent thing and cancel the contract.

The installing engineer had a duty to perform a site inspection to ensure that the property is suitable for receiving the satellite signal. Yes the tree might not have had leaves on it at the time of installation but he should have considered it's effect particularly if it's as big as the OP suggests.

So far the OP has done everything correct except cancelling his direct debit as Sky can now say he is in breach of contract.

He correctly had engineers out to carry out a survey and they have essentially backed his case in that he is not receiving the service he is paying for so it is very likely he has a strong case for breach of contract by Sky.

What the OP probably should have done was write to Sky and give them say 14 days to either put things right or cancel the contract. If he had done this and Sky still didn't play ball he would probably have a stronger case against Sky if it went to court, in that at least he tried to resolve the matter prior to going to court.

To be honest though this contract should really be terminated by mutual consent as in reality Sky appear to have failed in their provision of service to this customer.

"there is no and never was a clear line of sight from anywhere on my house"!

It would appear engineer No 4 was incorrect.
You did get a picture on your Sky dish and now you cannot.I know someone in a similar situation, unfortunately the trees blocking the signal cannot be cut down as there is a preservation order on them and they can only be touched if they become unsafe.

Sky did let them cancel the contract, so keep at them

I emailed sky's back office viewrr@.... after their own cancelletaion dept suggested to do so. I explained the situation and asked if they would negotiate a reduced fee during the summer times and revert back to full subcriptions during the winter. The reply did not mention anything about the signal problem and simply reminded me that I was in 12 months contract! Period.

I then wrote to them asking to cancel as they cannot deliver their service due to them failing during installation.

The reply was again no mention of the problem but '12 months contract'. Period.

This is their level of arrogance. They either are seriously underpaid and don't care if sky corporate looses customers or spends more money on legal fees.

From the first point of call I tried to reason with them, they ignored my problem and given absolutly no reasonable solution, BUT just '12 month contract'.

It is then I decided to stop my DD, hoping that it will get someones attention with some common sense.
  • In my previous home, I too had a problem with Sky where a tree blocked all signal when in full leaf! Sky did mention there may be a problem in the summer months and if there was, they'd return and find an alternative position.

Lo and behold, 4 months into summer the tree was in full bloom and we started to loose signal. Sky did as promised and came to move the box, but couldn't find a decent signal at the front, side or back of our property - so instead we had a lovely sticky uppy thing from the roof which was above the tree and viola, signal was restored (except in very windy/snowy/rainy whether) when we lost all signal and reverted to watching freeview! :)

    No.

The only person whose attention you will get by doing that is the nice man from the debt collectors...

Hi, did they cancel your contract or did you just wait until the 12 month contract ended?

Surely the website won't take account of trees in the OP's garden! Thats very accuate if it can do that!

thats just what it does, otherwise it would have been pointless informing him of the site

I'm sorry i've just had a look at this website and thats absolute rubbish! All the site does it tells you where to point the dish, theres a satellite picture which would show the tree is in the way i suppose, but thats obvious just by the OP looking out of the window! Frankly that website is useless and doesn't help at all!

Guys all Sky engineers thelmselves had trouble getting signal and the last engineer said it's obvious that the tree is the issue. As I stated that it was fine for first few months in late winter and interference began when the leaves started to grow. Nothing else is in the direction of the dish except that large tree and has always been there during instalation but without any leaves.

BUT I'm really anxious to find out what eventually happend to 'looktothefuture'. Did Sky cancel the contract or did they wait until 12 month ended?

goater, maybe the site is a little technical for you, although my 13 year old son has no trouble with it.

What you do is set the pointer corresponding to the position of your dish and it returns the max height which will allow a signal , relative to the distance of the tree.
    Quite simple really!!!!!!!!!
