Sky should never have installed the dish!

I signed up with Sky's all three packages in winter when the there was no leaves on a very very large tree from my neighbours garden that blocks my entire house, front, back and even the chimney.

After two months the leaves grew and the TV signal started to dissappear. On the 4th engineer visit, he concluded that "there is no and never was a clear line of sight from anywhere on my house"!

I told their cancelletion department, and even they advised to write in a letter of cancellation. Later, I thought i'll send an email asking for a price negotiation for the summer months I get partial signal and revert back to full payment during the winter, but they ignored such request and reminded of the 12 months contract!

I then wrote a letter asking to cancel as they are unable to deliver a signal to my house AND that their installer should never have installed in the first place. If I knew of the potential problem, I would of cancelled altogether. Even then they wrote back another letter as the first one.

I cancelled my Direct Debit. They kept on demanding payment. They then said they will cancel all 3 services and I will have to pay for 12 months contracted amount. I also decided that I must have phone and internet so signed up with another provider.

Now sky have passed my details on to a debt collection agency without taking me to court first. I have contacted the agency and managed to put it on hold as I was in dispute. To this date they have NOT mentioned one word about the tree, leaves or no clear line of sight and continously demanded payment.

It seems that they know that they have no solution so just hoping I'll give up and pay.

1. Are they not in Breach of Contract since they are failling to supply me the service for which I can pay.

2. Their engineer is the one with all the technical knowledge and went up the ladder, its not my duty to know what would cause intereference.

3. Are they allowed to pursue me through a debt collection agency before going to court?

4. If it goes to court, am I likely to lose?

5. If I lose, will I have to pay all the court fees?

    Where to? I did mention that there is no clear line of sight no matter where they put the dish on my house, front, back, chimney, etc.

    Is your house at the bottom of a sinkhole or something?

    Do your neighbours have Sky? Where are their dishes pointing?

    Please read my main post!

    It was their own engineer who concluded the tree being the problem.

    All my immediate neighbours dish do not point at any tree. Streets are not all straight in UK and many variables exist! Sky installer 'should have used his technical knowledge and not installed or at least advised me of the fact that a big tree is in the way'.

    Dont worry you get a signal is a couple of months time

    Can you get sky for 6 months of year when tree is bare?

    I cant believe a tree unless its right up to your house and a very large tree aka a Redwood can effect the signal that much other people manage I am sure its just a case of moving dish and taking readings with a meter for strong signal

    Dont you just love in when a person signs up and first post is a complaint and 9 times out of 10 there a victim and username of company is always used

    Get the neighbour to move the tree and sue them if they don't.
    Flippin inconsiderate neighbours, leaving a tree in the way like that.

    I've thought this numerous times...

    I tend to point it out to them and then they have a tantrum and accuse me of not being helpful! Me!? :rotfl:

    One particularly angry person was called RyanUNFair if I remember correctly... :D
