    Just to restate, the father's address details are locatable from Suzy Butler (the landlord) having used that address in her charity work - on a charity website. And apparently mentioned it in a news article a year or so back.

    And it is a very fair point for discussion and scrutiny, with this situation of the ignorant landlord supposedly living in a tent, whilst her lawful tenant with a valid tenancy agreement was living in her home; as a tenants do when they rent property from landlords.

    When it now appears her father/family live practically around the corner, in a big house of very high value. And where other news articles show her father deeply cares for her and where he admits he has previously helped buy the landlord an apartment in Peru.

    Just a post to round off the page. I'm saving the pages incase this gets removed and with this page complete I think it time to call it a night.

    On the more general point of a "level playing field" (or "even keel") of making a special case for landlords letting a single property there are a number of points that could be addressed:
    The tenant should be able to contact any company providing a mortgage of the property to ensure that they consent to the letting of the property and that the landlord is in good standing with repayments.
    This could be done at the start of the tenancy, and any failure to pay the mortgage could be communicated to the tenant.
    This would reduce the problem of tenants having to leave after repossession. This seems to be more of a problem now there are more "accidental" landlords... people are letting without proper permission, or financial resources.

    With the best will in the world Chris I don't think giving x number of prospective tenants (what would be the point of checking up on LL after signing AST) info on the financial standing of a LL would be possible. It would be nice though yes.

    I'd like to see more honesty (don't splutter out your coffees!!) if accidental LL who plans to rent out only for 12 months then TELL prospective tenants that! don't give lip service to prospective tenants "yeah yeah, long term plans" when they know damn well they are desperate just to get someone in short term pay their mortgage. I honestly feel used when this has happened.

    There needs to be more education. Like the ad on TV for LL insurance. "If something was to happen ..... etc". Obviously it's for advertising their own product but it does give a slight indication that rules are different when you've rented your house out.

    Maybe an advert with dom littlewood:

    Dom: Have you decided to rent out your home ..... ? don't think you're a business ..... ? well I'm here to tell you, you're wrong

    Dom: For example you can forget knocking on that front door without permission from your tenant first.

    It could go through a few salient points and then end with a website that helps new/accidental LLs.

    Just for fun, let's blow the tent out of the water.

    Had Suzy approached her local authority as homeless, they would have a DUTY to provide her with alternative (temporary) accommodation while enquiries were carried out. (1996 HA, Part VII, S188). So there was no need for Suzy to be either sofa surfing or living in a tent.

    Not sure if this has been covered elsewhere in this or the previous thread, but more interestingly if the tenant had approached as homeless, she would have been advised that until the landlord has issued a S8 or S21 notice (as may or may not have been done, who knows), and even when the notice period has ended, the landlord still needs to go back to court and get a bailiffs date. She would have been advised to stay where she was until the correct procedure had been followed.

    Meanwhile, a quick phone call to the landlord would have been made advising them of the correct procedure and to seek independant legal advice if they were unsure what to do next.

    It will certainly be interesting to see what the update on their facebook page comes up with next.

    I certainly hope that the Enforcement team at Brighton Council will be taking action against Miss Butler for the harrassment and illegal eviction of her lawful tenant. Afterall, the landlord seems to have done all the hardwork in proving such a case by having the media supporting the harrassment of her tenant and recording such harrassment for the world to see.
