& I asked you to explain the process involved, somebody helped you about by saying "take it to the small claims court".....
So you have say 5 nuisance people parking per day, ranging from 10 mins, to 3 hours.
You then have to get all the evidence for each person, each day.
So whats that, 5 digital photos, recording of time entered, time left, number plates.
Then these 5 cases per day then have to be adminstrated, letters sent asking for reimbursement.
Then the 5 cases per day have to go to court.
So in an average working year, you are going to have 52 x 5 x 5 = 1300 cases in the small claims court, per small business.
Brilliant solution.
Thats the legal system for you. It's either worth the hastle or it isn't. Charging people more than the loss they have caused you by hijacking their car and holding it to ransom is just plain wrong and if you can't see that you are an idiot.
I repeat that ALL clampers are scum unless you can show me one that charges less than say £200 -
Early next year is my best guess for ban in force but depends on rest of Freedom Bill. Outlawing clamping is actually very easy as all licences are simply revoked. Penalties will be beefed up to around £5,000 fine/6 months jail for each offence. There is zero chance of this legislation being stopped as clampers have absolutely no support in Parliament. In fact MPs are sick of getting mail from constituents about the activities of these scum and had been pressing the Home Office for the ban.
Small claims court actions are very unlikely to succeed as those very few PPCs that have tried it have found. The law is rightly on the side of preventing one citizen from applying a disproportionate penalty to another, even if a breach of contract can be proven. No doubt Perky or some other idiot will pop up to extoll the option of taking cases to court but the serious PPCs will steer clear, as they already do.0 -
Make an enforceable punishment against people parking on other peoples property?
Don't ask me what this punishment would be or how it would be enforced though?
Make it illegal to park on private property without permission?
Exactly the wish of the Private Parking Companies who I as said previously will be looking to exploit the imminent demise of the clampers to line their own pockets.
There is not much honour between these two groups it seems.
I do not find it strange that this thread has finally arrived at that point.
A large amount of long standing well defined and accepted Tort, Contract and Common law already provides ample coverage.0 -

I think a "legitimate" clamper was spotted in a UFO with Elvis Presley heading straight for the Loch Ness Monster.0

The nearest to legitimate I have seen is a local pub which (threatens to)clamp for unwanted parking and release of £20.00 cheque made out to the local hospice. Don't know if they ever clamped anyone though.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Those that are licensed, registered and conform to the government guidelines. Simple enough, or maybe not as simple as I presumed.
Earlier you implied that the government was right, and I was wrong, I couldn't be bothered to explain this to you, as I believe you actually already know the answers to the pedantic questions you ask.
But again, you only chose to accept the government being right when it is doing something that supports your argument.
Rather than use your judgement that every single clamper is a cowboy, I come to the more logical conclusion that some are good, some are bad.0 -

I could see the clamping firms taking it to some Human Rights court, on some sort of appeal?
Maybe even the landowners themselves, they need something official which actually stops using their land as a free car park. It may be money saving to the ignorant driver, but it does cost somebody else in the long run.0 -

So a person that would have to pay £15 for parking all day every day in a train station, is really going to be bothered if they got charged £20, if they got caught parking on private land? Say they got caught twice a week, they are still £35 better off.
It doesn't make sense when you stop to think about it, but most people don't stop to think before posting on this thread.0
