Recently my daughter won a county court action against a wheel clamping company and they have refused to pay up. In fact, they have totally ignored (it appears) all correspondence from the court so the court found in her favour. Needless to say, in order for the court to take further action they require another £100 and leaflets explaining the different courses of action seem to indicate that she would be wasting her time pursuing payment. Where is the justice in that?

These cowboy clampers that everybody keeps referring to, did they actually go around on horses and heard up all of these unsuspecting motorists and force them to park on private land without permission?
No they just box in motorists/delivery drivers and hold them to ransom. Not much difference.

No - they are totally oblivious to any form of verbal discussion, plea or whatever.

    Cheers

  • As the RAC says these clampers were the modern equivalent of highwaymen, lying in wait to pounce and making sure that the motorist had no real idea of any restrictions. !!!!!! Turpin at least wore a mask but for far too long these bloodsucking leeches operated openly as if they were above the law. Having behaved in this way, been too thick to see which way the wind wasblowing and brought this action on themselves they now go bleating that it is a "charter for selfish parking". Yeah right, as opposed to a charter for daylight robbery.

The decision is made and the vast majority of people will applaud it whether they have been clamped in the past or not. Look at the papers today - it gets a universal thumbs up. I have to say I was very sceptical of this coalition but they have excelled themselves here. Hopefully they will continue down the road of calling off the war on motorists declared or encoraged by their predecessors.

Unfortunately she has learned the hardway that clampers will do anything to avoid their obligations. They will routinely phoenix businesses to avoid CCJs, operate from PO Boxes etc. etc. Again these are not the actions of legitimate businesses and this was no doubt one of the reasons that the government ultimately decided that these scammers would never comply with any regulation in any form.

The mistake your daughter made was not to include the landowner in the action. She would have had a much better chance of getting her money back from that source.

    What war was this then?

Oh, was this the war that ended civilization when clamping was introduced, the only people to survive were those that fled to Scotland. :rotfl::rotfl::rotfl:

There's still time and a judgment in her favour would help.

Liam, people have offered up numerous solutions for landowners but you have rejected every one of them. If you are a shopowner then do say so. That way your rejection of everyone's ideas would seem slightly more rational.
Just because you don't like the ideas doesn't mean others wouldn't opt for them.

I feel this thread is becoming very repetative, as people haven't read previous posts before making comments.

There have only be limited suggestions that would only work in specific circumstances, not numerous solutions that have been rejected as you incorrectly put it.

I have just tried to enlighten a few narrow minded posters that not all business are multi million pound empires, with endless resources to combat the nuisance drivers who park without permission.

What concern is it to anybody on this thread as to what I do for a living? The same could be asked of every single person on this thread, but the relevance is neither here nor there.

I have told people I am not a clamper, nor do I have any association with clamping or any other firm or anything of that kind.

People have stated that the only reason they have made comments on this thread is because they don't like clampers, no other reason.

If you go back and actually read the questions I raised, you may be able to add something to the discussion, rather than just jumping on the band wagon and making comments on what you think I should and shouldn't have an opinion on.

Most of my posts are just in response to people who are being abusive toward me for having a different opinion to their own, they are not actually adding anything to the discussion.

Sadly most of these scumbag companies will simply ignore CCJ's which is why we advise people to sue the landowner as well. As, unlike the clampers, the landowners usually have assets and reputations to protect.

Sadly in the run in to abolition of this foul practise we will see clamping fees go through the roof. The situation will become dire until it is banned.

People need to ensure that the landownercontracting agent is also sued at the same time. Jointly and Severally.
