IB failed medical, they are taking the mick big time!!!

    Have I got this right.. The decision makers rely on the atos medical people who fill in the forms at the medical. the people at the medical dont have anything to do with the actual decision.

    If this is correct it is no wonder that there are so many people complaining. If the atos medical people filled in the forms correctly and didnt make assumptions (as they did at my husbands medical) and blatantly lie (as they did at my husbands medical) we wouldnt have all this mess!! He is just one person, muliply this by thousands.. Im not saying all the atos medical people do this, but, it makes me wonder why some of them do, what are they getting out of it.

    But, on another thread, you said quite clearly that your husband was capable of working, so I don't see how you can complain that the decision was wrong.

    I do wish you the best for your appeal. However, remember that the DM/ Tribunal will be looking at your medical condition and not any maladministration. If you do feel there has been maladministration, you can make a complaint about this separately, to ATOS and/ or the DWP.

    Thanks for that as never thought of putting in a seperate complaint to ATOS\DWP. Not that they will admit any liability on that front, more so in being asked what symptoms do you get from a thyroidectomy. If the IB50 was read the doctors would know of a condition to have done so research and better known to ask about something they clearly knew noting about in the slightest.


    Right, if I send the GL24 off incomplete (due to unknown waiting time for paperwork) is it therefor possable I'd be running the risk of a default judgement against an appeal on the basis I never provided them with a propper informed statement of reasons for the appeal?.

    What if in the worse case for ATOS\DWP the original papers did award me a threshold but the report from the desicion makers never reflected this?. Would this not change the reason have to put down now for the appeal. Meaning it could be claimed I lied\jumped the gun in the reasons I put in the GL24?. Think it best to phone and double check tomorrow.

    Or is it suggested I simply lodge my appeal to get it dated now but not send the form as such untill I get the paperwork?. We are getting an income via Income Support so I guess we can wait that little longer.
