    If you are capable of working then you are claiming IS for incapacity fraudulently.
    I am capable of working. However, the problem is I have Asperger Syndrome. Whenever I go for interviews I have extreme difficulty communicating effectively hence the inability to get a job, there is always someone else who does better than me in a competitive job market where there are few jobs out there and employers can pick and choose. The incapacity assessment by a doctor decided that I need not get sick notes from my GP, I'm not sure why as I expected them to say I am able to work. If no-one will employ me because of my disability, am I therefore not "unable to work due to disability"?! The other difficulty I have is employers don't seem to be able to appreciate a condition like AS is a disability, and just see a socially awkward person and think all the negative connotations that come with that.

    Even application forms discriminate against myself, the ASDA one being a good example, as it asks questions which relate to my disability (and I assume these are used against me since they never got back to me).

    I'm confused, if you readilly admit your capable and able to work, why are you on sickness benefits and not JSA?

    You mentioned on your other thread that you have an appt with a DEA. DEA's at the JCP do not have a lot of resources available to them, so at your appt I would ask to be referred to the Pathways provider in your area (or in some areas you can self refer). They will have more contacts and financial resources available to help you.

    There's a rather complex set of circumstances as to why I ended up on incapacity benefit in the first place, if I leave it at saying I had a long stay (few years) in a psychiatric ward due to my condition.

    As I say anyway, the difficulty is in getting the job, not in doing the work.

    You're confusing the 2:
    Not being able to get a job, doesn'r equate to unable to work.

    They have good reson to ask about disability. May not apply to you as such; but there are some disabled people out there who need resonable adjustments when it comes to interviews.

    not really he may have young children that he has not mentioned as well an it is up to IB to acces him with regaurds to his disability which he obviously passed and was awarded

    The fact that he says " I was on income support due to incapacity, " is a bit of a clue.

    Are you actually applying for suitable jobs?

    The fact that you have difficulty finding work is totally irrelevant to you ability to claim incapacity benefits. I imagine that you will need to look for work once you are switched to ESA.

    Apparently in my area it is the New Deal for Disabled People http://www.direct.gov.uk/en/DisabledPeople/Employmentsupport/WorkSchemesAndProgrammes/DG_4001963 and the job brokers are Shaw Trust and SEETEC (both quite a distance from me). The support seems to be more geared towards improving interview skills, and providing work experience. Sadly none of the bumf anywhere says they can do positive discrimination and actually just hand you a job, which is what I'd like TBH. I would again be relying on finding an understanding employer, who can see through my difficulties in the interview, which I haven't managed to yet. Unless the schemes can hand a job to me I doubt I would find much benefit from them, but will give them a try (although travel costs may be an issue if no funding for that).
