So the outcome for the band was that through this debacle, they have simply received 'critical acclaim' for showing everyone how not to do customer service.
Who ever thought this was a good idea to pursue needs a quick lesson in the old adage 'you only have one opportunity to make a good first impression'. Sadly, it would appear greed and stupidity got the better of the manager and only when it was abundantly clear they had not a hope in hells chance of winning a court dispute, did they again take the cowards way out and suggest someone else had booked the date. Woeful way to present your business!
The mark of a good business is how they respond when things go wrong. In this case the band's management appears both inept and cavalier with their reputation that they had hoped to promote.

I'm not sure that this episode does end on 'their terms'. I'm pretty sure that they have invented the nine piece band booking in an attempt to hush up the whole episode.
Smells fishy to me. They change the website so that people can't check availability without emailing them and then sudddenly 'invent' a booking. Hmmmmm.0 -
That's good news agmoore, good luck with the wedding.
If any good comes of this matter it may be that more people will read and understand any terms and conditions on websites etc before they commit to. In addition it may also help other people realise that the law on this matter is reasonable in that the other party have to mitigate their losses so it may help other MSE readers who are in the same position as you with a supplier.

Yes but the issue still is that the T&Cs changed between the couple booking and this whole fiasco.
I think a lot of people are more savvy now about checking the small print but this case was so unfair because on the one hand the terms said a booking wasn't firm without a deposit but the company tried to say that the booking was firm.
I think the message out of all of this is - google any company you're thinking of using, print out a copy of the T&Cs as they are when you agree to them and more importantly don't just roll over and give in when companies try and take the mickey like this one has tried to do!0 -
A twist on things...
OP's OH wants to book the band. They exchange emails and agree on a date and venue. OP's OH hasn't yet sent the deposit, and someone else comes along in the meantime, armed with the deposit there and then, and books the same date.
The band would take the 2nd booking wouldn't they as they're the ones with the hard cash to SECURE THE BOOKING. The band would tell the OP 'we're sorry, you didn't pay the deposit, so your date wasn't secured'.
So, if the band think they are right in all they have threatened the OP and their OH with, and the above did happpen, then surely the OP and their OH could have taken the band to court??Tank fly boss walk jam nitty gritty...0 -
They say all publicity is good publicity but this thread can be viewed as a disaster for Hula Groove they or their manager have blundered about like a bull in a china shop when given the circumstances it could have been sorted so easily without the bullying stubborn attitude.
I never say never in court cases but I doubt even if they had taken court action they would have got very far and a sympathetic judge would have seen though them quite quickly.
