Takoda,
Nothing has been paid. The band are suspending legal action until the actual date of our wedding 28/12/10. To quote from said email..

"If the band do not receive another booking for the same date then the full cancellation fee will be due and legal action will be pursued if payment is not forthcoming.

If the band do in the meantime receive another booking for 28/12/2010 the cancellation fee will be reduced to the level of any actual loss incurred by the band."

Ultimately we want an instant end to this, but it is clear this is something that will not be dropped by the band.

Whoever posted that it's cast a negative vibe is absolutely right. Again, it is a shame that we will remember this for all the WRONG reasons.
They have no chance of winning a case. Just the fact that you never paid a deposit shows you never confirmed the booking. So if they get a booking or not that night makes no difference. As other's have said they are just trying to save face but all this does is make them look even more ridiculous.

If they want to save face they should be dropping these stupid threats and giving you a full apology and buying you a nice Wedding present as they are tainting your Wedding with their stupid and childish actions.

They haven't got a leg to stand on but it's just annoying that it will be hanging over you. As others have suggested it may be worth contacting your local paper, they live stories about possible ruined weddings (I know it's not ruined but play on it a little) also consumer programs etc.

The place to resolve this matter is now in the County Court, not the Kangaroo court of the MSE forums.

I think we should take that as a compliment.

No need to lower the tone of your response with a smarmy comment like that. Now back to the kangaroo courtroom ....

What's that Skippy?

'tchk tchk tchk' A couple's wedding might be ruined because they cancelled the band Hula Groove?
'tchk tchk tchk' And the band wasn't even firmly booked because they hadn't paid a deposit?
'tchk tchk tchk' But the manager still wants to take all of their money? Strewth! we'd better skip along and see what we can do!!! Which way did they go Skip? :rotfl::rotfl::rotfl:

For what its worth, I don't think we should underestimate the effect that having the threat of a court case hanging them for 5 months is going to have.

We can all sit in our homes and say that it isn't going to happen but agmoore and his fiancee don't know that for sure.

Oh well agmoore they are now bringing mental anguish and distress into the equation.

This lot are an absolute joke.

The fact alone that they have altered their T&C's after you made a booking means they would absolutely have no chance of enforcing anything in court.

Looking at the date of your booking this lot want to put their feet up over Christmas and get money for it!

They are trying a different tactic in that they are saying they will wait to see if they get another booking in the meantime when I bet they will do nothing about it.

Well IF it goes to court you will also now have a case of them causing you distress in the period up to and after your wedding so it's looking good for compensation for you. Keep at it, it looks as if this will end up costing Hula Groove not you. :)

Here are the band members as taken from their Facebook page (so already in the public domain)

Asya Satti, Marie Agathe Pecquet, Kerry Thorpe, Claire Marie Woolgar, Tim Selywn, Sam Sharawi, Jim Hawker, Justin Shaw, Danny Richman.

i decided to put their names here because in his one, single post Danny blames them for having to ask the couple for the money. here it is: "When we receive a booking from a client we immediately engage those musicians. If we cancel our contract with those musicians we are liable for their cancellation fees and lost profits."

Now any of those people listed could turn round to their manager and say. It is OK we know this couple got cold feet about spending a significant amount of money on a band. We understand their situation and are sympathetic. So don't worry about the cancellation fee - we'll forget it.

But they haven't made that choice. So they are as bad as the manager in my opinion.

UPDATE!!!!

A couple of days ago it was possible to check Hula Groove availability on their website. Before we knew the exact date of the wedding I checked a few days before and after Christmas. All of the dates came up with - CONGRATULATIONS! Hula Groove are available for your event! That's why I suggested earlier that they might be struggling a bit to get bookings.

Well - when I just tried to check availability a few minutes ago GUESS WHAT????

He's only gone and changed the way his website works. Now when you put your date/event and location in you get a screen which says:

FINAL STEP!!!

For security your quotation will be sent instantly by email.
We would never spam you or pass your details on to any third party without your permission.

Well, well, well. Mr Richman doesn't want MSE members to be able to check whether or not there has been a booking after all for the 28th December. The plot thickens. It cannot be a coincidence that in the last few days he suddenly decided to change his website. ;)

Also interesting that 'Rob' isn't listed as a member of Hula Groove on their Facebook page. The Facebook page said they had edited their members recently. ;) Maybe he was removed because he has his own website with his availability dates on it. ;) His site is worth a watch though.
