    Here’s some good news about the ongoing scourge of phone harassment. Maybe consider doing this.

    If lots of people do this then perhaps some or even all of the massive problem can be solved :


    Victory over cold callers: Homeowner wins damages for time wasted answering phone

    • Richard Herman billed firm promising PPI compensation £10 for every minute they wasted of his time
    • The Surrey businessman recorded the calls to ensure he had enough proof
    • AAC, which sells referrals to management companies, agree to pay £195 plus a £25 court fee
    • Victory for the 'little man' gives hope to millions of other pestered homeowners
    • Herman owns call recording company Retell Recorders - and this experience aided the prosecution
    Mr Herman has now set up a website – www.saynotocoldcalls.com – to help other victims, and is appearing on BBC Radio 4’s Money Box programme at midday today.

    I nearly posted the same story as I thought it represented a victory for the small man against cold callers. That was until I actually read the story and realised it was rather 'twisting the truth'.

    There was no 'prosecution', it did not go to court and no damages or compensation were awarded. There was no admission by the PPI claims company that they did anything wrong.

    It may make a good story but the guy has managed to promote his own company in the newspaper and on the TV for nothing and promote his 'No cold Calling' website where he invites people to e-mail in for more information. Perhaps he just wants to sell them telephone recording equipment?

    The fact that the company settled out of court and paid the invoice doesn't detract from this being a "victory". The evidence Mr Herman gathered would have been more than enough to win a small claims case so the PPI company really had no choice but to pay up.

    And having looked at his website, you really can't call it a "company". It's simply a detailed set of instructions on how to do the same thing he did.

    You don't by any chance work for the company he invoiced do you ? ;)

    If you read the newspaper article a little more carefully you will see that this guy is recommending that you should record cold callers. Fair enough (I do the same) but then you will see that this guy actually owns a company that sells call recording equipment!

    The name of his company, of which he is the only director, appears in the newspaper article three times plus the shirt he wears bears the company's logo. All free advertising of course!

    Mr. Herman has clearly done the rounds to promote his 'win' and promote his company at the same time, going to several newspapers as well as the BBC.

    Seems that Mr. Herman is using the publicity from the newspaper article to promote his business. He is sending out emails on the back of the free advertising he got from the newspaper article!

    Yes he did invite people to ask for more information on how to beat cold callers but these people are now on Mr Herman's mailing list and he is inviting them to visit his website where he sells call recording equipment!

    Mr. Herman clearly believes that if you can't beat'em then join'em! Well done Mr. Herman but do people really want to know about your overpriced equipment?

    Maybe I should now direct those same people to my my website where I can sell some equally-overpriced e-mail-blocking software?
