    They could probably still recover the money if they took the company to small claims court. Whether they would actually pay what the court orders is another matter.

    'Tis done. I wander over there very occasionally as 'Coupon'.

    Hope some more people email Mobilise, I had to send mine twice as you can see but at least they replied. I will email Mobilise again when I get a mo in a few days, as they have made some points I would like to reply to them about.

    Everyone please feel free to email them even if you have nothing to add except that you are shocked that a charity can get involved with a private parking company who are known to issue tickets and then threats to the very people Mobilise represent. I really don't understand why they do not 'get' the points about all people who meet the DDA definition of disability being entitled to use disabled facilities.

    The DDA doesn't differentiate, so who are they (or we?) to say that someone with certain 'other' disabilities should be banned from parking near the store. Blue Badges do not apply in private car parks, not even if PPCs want them to - but the DDA does!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    There are some interesting comments over on Pepipoo relating to Mobilise's reply.

    Also the disabled person featured at the top of this story has confirmed that he hasn't had a reply from Mobilise to his August 16 letter.

    Yet another story about the "ethical" UKCPS. This time from Pepipoo:-

    I am a disabled man and I parked in a disabled parking space in Great Northern Retail Park Huddersfield just outside of Homebase.
    I placed my blue badge on the dashboard slammed the door shut behind me and went in Homebase to pick up a paint card. it took me five minutes. When I returned to my car I noticed the Parking Notice Charge on my windscreen, on checking it, it said there was no badge displayed, I then noticed my badge had slipped to the floor. I went back into Homebase with my blue badge and the Manager agreed it was up to date. I then showed the notice to the guy at Perrys where I had just recently got my Motability car from, he was astounded and said, apart from anything else, your tax disc displays disabled on it. He contacted UKCPS and spoke to a guy in administration who was amazed the car was from Motability and said I hadn't to worry and to appeal. I returned to Homebase and saw one of UKCPS' staff with his tickets. I related the above to him, and he could see my disability. He said he hadn't given me the ticket but he would back up my appeal when he got back to the office.
    I wrote my appeal and have just received a reply saying they sympathise with my situation but it is the driver's responsibility to ensure the blue badge is displayed (which I did), and that UKCPS are working to stamp out abuse of disabled bays, (but I wasn't abusing it), and the parking charge will stand...£100 reduced to £60 if paid within 14 days. I can't afford that. I am totally stressed out with all this, which doesn't help as stress increases my disability. I don't know what to do. I didn’t know of the existence of PePiPoo until after I appealed, which I now realise was the wrong thing to do.

    And yet another case concerning UKCPS and a disabled driver (from CAG):-

    Hi all

    I parked at Aintree Retail Park outside M&S on double yellow lines with my blue badge. I wear calipers on both legs and can't walk far and there were no spaces near either disabled or ordinary. When I came out ten minutes later there was nothing on my car, but 3 weeks later I get a letter stating I haven't paid my fine and it is now £100. I phoned their number and got the 'pay now and appeal by email otherwise it is an extra £3 a day'. I didn't pay and emailed them to state what had happened. Of course there has been no reply. Today I have received a 2nd reminder notice. I have read the forum with interest, especially the gentleman who went to the police. I am happy to sit it out and see what happens and hopefully they will eventually forget about me! Fingers crossed.



    And a later posting:-

    I've had three letters from UKCPS and now my first one from Court Proceedings. I parked on yellow lines but put my blue disabled badge out - callipers on both legs. I am not paying! If I can park on yellow lines on the main roads why not at the Aintree Retail Park?

    I mentioned this earlier in the thread, but dealing with the office monkeys doesn't seem to be getting anywhere.

    A well structured letter to the Trustees may get some action. Charity Commission website has trustee details.

    A disabled driver who is receiving PPC threatograms should also contact the trustees and send copies of the letters sent when PPCs deem you have broken some rules they have made up.

    I guess if you would rather take the advice of someone with a vested interest, instead of someone with legal knowledge, Mobilise’s stance over PPCs is bound to be the outcome.

    Oh what a surprise - a member of staff of the BPA saying the tickets are valid.

    "It is lawful for a landowner and manage his land and seek compensation for breach of contract"

    Only if you can prove there is a contract which most PPCs have real trouble doing when it gets to Court.

    Only if compensation is not seen as a penalty which PPCs also have real trouble proving when they get to Court.

    I hope being a charity they have also had the brains to contact the Solicitor in the Watchdog programme to get his side, as at the moment it appears the Charity only takes advice from it's paymasters.

    I agree that if everyone gets wise and decides to ignore it could be chaos, but isn't this an issue for Government to address and not a membership organisation paid for from money obtained by deception?
