and do you think it's right that the insurers are not going to pay out when someone has their baggage stolen?
If they fail to stick to the terms of the insurance, which they took out, read and paid for, then yes, its right they don't get paid out. Unfortunate for them, but right.
Just because someone is not going to be paid out does not mean you can commit fraud, which is what you stated they should do (even though the police and the insurance company had already been notified).

i think that this person has a very good case for going back to the insurance company as the person was travelling in a licenced taxi to the airport and their bag was stolen. the bag would be accepted by the carrier into the taxi and so would in my opinion be attended.
it is similar to leaving your bag in the hotels luggage room. i would expect that to be covered as well.
if you go into a hotel and let the porter take your bags to your room, or go on a cruise and let them load the cases for you, you have left them unattended but you would expect your insurance to pay out. i don't see how this is any different as the person handed the care of the cases to a licenceds taxi driver.
i would think that ultimately the ombudsman would find in your favour, even if the insurers reject your claim.0 -

Thats not playing them at there own game, thats called fraud.
The "game" the insurer is playing is legal, fraud (which may come as a surprise to you) isn't.The wording on the policy are clear. The OPs son is at fault. End of.
Although I would try and claim as they have nothing to lose, claiming they took all reaonable care. May not get them anywhere but its either that or concede. I used the same tactic years ago on a theft claim (property was stolen from my porch, I took all reasonable care, they did pay out in the end)0 -

Apparently luggage is only deemed attended( on a travel policy) if it is in your possession or locked in an hotel room. We found this out the hard way en route( 8 hour drive up from France) to the airport in a hire care, stopped in Barcelona, left car unattended with luggage out of sight in boot for approx 45mins on a main street. Brick through window,hand luggage stolen, other luggage rifled through all valuables gone.
Travel Insurance refused to pay and so we had to claim on house insurance, is this an option for your son OP?0 -
