taxi stole my sons baggage tesco wont pay

hi my son went to Majorca last week to return on Tuesday mid day, he left his hotel at 7.30 put luggage in taxi and started trip to airport, a few moments later he realised he hadn't enough money to pay the driver, explained to driver and asked him to pull over so he could get money from cash machine to pay him. Which driver did. Son jumped out, shut door, walked to machine. Put card in machine and watched in debelief as taxi sped off with his luggage. Son ran down street after car. Gone!!! Walked back to hotel for help/ advice nothing. by the time he had reported loss to police and got to airport his flight had gone, he had to pay for another flight. I phoned Tesco to see if he was covered for flight home costs and find to my dismay he isn't even covered for luggage. Apparently its classed as unattended luggage. Can that be right you walk out of hotel get into a legit taxi or so you think and not covered. In that case are you covered if say you need a luggage trolley at airport, and you have to leave your luggage to get it. And same thing happens what about your coach. Views please I would love to hear any other experiances

You don't have a claim as the luggage genuinely was left unattended - neither would you have a claim if you left it unattended in an airport while you got a trolley. Always leave someone with luggage while you visit an ATM, or get a trolley - if you are travelling alone then take the luggage with you at all times - even to the cash point.
I'm not sure if he has a claim for the missed flights costs either as he was responsible/at-fault for the loss of luggage which resulted in his delay in getting to the airport.Legal team on standby0 -

So take this argument further. As long as your luggage is left somewhere with people, its attended. I can now leave my luggage in a train station, go away for 10 hours, and say its attended as people are around.0 -
Fred I understand your argument, but take the other view a taxi is no differnet to a coach, have you ever been on a long coach transfer, that pulled up to service station and rep says you can use the loo facility. I have, and never dragged my bags with me. I always thought they were covered. Do you always take your bags to the trolley park to get a trolley. I always take my trolley to the Taxi!0

Are you sure the taxi driver understood that your son was getting out to get cash?
Maybe the driver thought your son was getting out and was not going to pay the fare?Tank fly boss walk jam nitty gritty...0 -

did he book the taxi with hotel .. or just get into one in the street#

No stolen luggage is unattended when the theif helps themselves to your belongings, otherwise they would remain unattended. Is that your line of reasoning to the insurance company - ie "there was someone there; the thief!! So it wasn't unattended, please send me money - ha!" ??????

So, did he take reasonable care with the bags. If you want to argue this with the insurance then go ahead, but first read the policy document which may state it must be attended "by you".0
