taxi stole my sons baggage tesco wont pay

    I am sorry you are having trouble with understanding the terms and conditions of insurance policies, and the purpose of them.

    If pointing out to someone that the terms and conditions of an insurance policy SPECICALLY exclude what they are trying to claim for is "stupid point-scoring" then god help you.

    So you are now advising the poster to commit insurance fraud, even though they have already discussed the case with the insurance company AND filled in a police report stating the facts.

  • melb yes the ironic thing is he did report it to the police, and got a crime number, and its due to that he ended up missing his flight whcih then cost him £120 to get back to Manchester airport rather than Birmingham where he should have been. Reporting it to the police was my idea!!! If he had just jumped in the next taxi and gone to the airport he would have caught his flight!!!
  • Only thing you can do is to try and claim, then appeal. Worst that can happen is you waste a bit of time.

    I quick check on the Tesco insurance site shows that it is a condition of the insurance that :

    You must provide receipts for lost or stolen
    items in order to substantiate your claim.

    I would guess that this would be used as a secondary reason for refusing the claim! (I am guessing that the son does not have receipts for the case and the things in it - I wouldn't)

    if the taxi rank is just outside the hotel they should know the name of the company. if there were 2 other taxis there then they may know the car involved. however, if the taxi was part of a bona fide company on a rank you'd think it would be unlikely they would risk doing something like this as it would be too easy to trace them. You need to get the police involved in trying to trace the taxi firm if this is your son's only recourse to compensation. Good luck. Insurance companies are loathe to pay out at the best of times and the slightest little detail is enough for them to try and wriggle out. My OH's car was stolen and it took over a year to get a payout. Excuse after excuse until we wrote to the CEO and we got a cheque the next day.

    Why was the claim denied. Or is it a case of asking if its likely to be covered and they said no.

    I would still try to make a claim and let them decline it in writing.

    If its rejected on grounds of the luggage not being in your care, specifically ask how close luggage must be to be classed as in your care.
