A bit bolted horse but if uncle's extra income source is removed, he might try it.

Thank you, as additional concerns now include if there is a will that the 2 siblings do not know about, my mum is concerned that things may take a sinister step now the additional income has been removed. I told her not to be daft that he would not go that far, but none of us thought he would steal from him........

Also if your uncle is on any means tested benefits such as housing benefit and council tax benefit then DWP will class this as fraud.

So there is a lot to think about.

I will brace myself for that thread.

Yes, he does, it was ex-council that I believe he bought outright approx 20 years ago? Had a small mortgage, paid off.

Value approx £150K as a flying guess.

He is, I believe, on both of these.

Then he needs to be reported for fraud then.

As you can't have any more than 16K max to get means tested benefits.

And if he has spent the money it will be classed as deprivation of captial.

Which means they tread it as if he still has it. And they only allow X per year to be drawn down. And that sort of money he would not get any means tested benefits for years.

I am not sure if "gifts" from Granddad would count as income, even if he did not know he was making them.

However, I think you should throw everything at the theiving so and so, so get him reported.

My only thought is that he has now got married and moved in with her about 3 months ago. I have no idea if he has told DWP. If he has, will tehy even look into it as it was in the past?

It looks like approx £80K at the moment. What are the likely ramifications of this coming out? Some sort of sanction, or prison?

The money has to be somewhere. It is very hard to make £80K + disappear.

Unless he has bought a house the money has to be somewhere.

Even if he took it in small amounts of say 2-3K at a time. The DWP will need to know about the money. So if you know the money went missing say from Jan 09. Then your uncle will have to let them know. We are not talking about a few hundred pounds this is tens of thousands and would need to be declared.

The DWP will be able to look in to his bank accounts. Was the money taken in cash or cheques or internet transfers? There are trails for all of above. If it was cash how was the cash got out? etc etc.

Depends on what can be proven will depend on what happens.
