Uncle taken money........

Thanks for all your replies.
I think mum and bro are planning to report it to authorities, it is just that granddad is so adamant that he is ok and I can only compare him to my gran before she left, and was clearly mentally impaired by the end.
I think my mum and her bro and in shock TBH.
Younger bro has been declared bankrupt previously, not sure if that has any impact on anything?
What, if anything, are DWP likely to do. Or should I post on benefits board?0 -
If your gfather does need to go into nursing care, say within the next 2 years, and his bank statements are examined to check his financial status will queries not arise about deliberate deprivation of assets?
Well yes, I suppose it will, we just always assumed there was enough in the estate to pay for it, so never looked at that..........0 -
Sorry I can't really be of any help, but we are in a similar situation in our family, its really sad in a way that people can do this to their own family members and also causes a lot of anger, the family member in my case has since died but the estate is a lot less than it should have been, the family member was getting the pension and doing the shopping but also getting their own shopping ,taking money for petrol etc, but possibly £80 or so each week and this went on for a number of years.0

Elderly folk always insist they are OK in this sort of situation. People are often diagnosed anyhting up to 15 years before they die and may appear OKish for a decade but have impaired abilities in some areas.
To put it simply, if your Gf did not know the money was going, he could not have given consent.
As for uncle having been BR previously, that is quite common when people's incomes have been slashed by ill-health. If however he had to go BR again because of this case, the fact that it involved fruad could mean lengthy restrictions on him (BRO/BRU).If you've have not made a mistake, you've made nothing0 -
How anyone could do this to their parent is beyond me. In my eyes it is theft plain and simple and therefore I would urge your mum and uncle to report it to the police and the bank.
I would also consider putting an "enduring power of attorney" in place. This will give your mum and uncle the power to look after your granddads financial affairs.
Unfortunately it won't get the money back, however should help to stop further thefts and will also help when future decisions need to be made regarding care for example.I am a Chartered Financial Planner

Thank you, power of attorney was applied for yesterday, and it has all been agreed in principal to either be for other brother or shared with other bro and my mum.0 -

I know he has not given consent, but he will tell anyone that listens that he DID give consent. I will speak to mum further about this option though.
He has been on disability benefits for some 20 years now, and went BR about 4/5 years ago.0 -

Sounds like they will have applied for the pack, not yet sent it to the PGO.
Would recoommend that mum and bro go jointly but allow one person to make decisions up to a certain limit.
That means that if bro wants to go on holiday or is unwell, mum can pick up the case for a few weeks. Otherwise things get very very difficult. If you've have not made a mistake, you've made nothing0 -
Look into the CIFAS website to see how to put protection onto your grandad's finances.
Chances are that the son will try and continue to exploit the grandad - there's always the risk that they may apply for credit in their name, get hold of new cards and so forth.0 -
