Anyone any news of when we`ll get our money from the CAA for the Goldtrail failure... we sent the form in over 3 weeks ago.
You will be pleased (not) to know the CAA have confirmed they cannot find my claim form.
It was sent to them 5 weeks ago from Travel Republic along with my supporting documents (Travel Republic sent me an email saying they had completed section 9 and sent it to CAA).
The annoying thing is I had called the CAA a few times in the last few weeks to confirm if they had recieved my claim form but everytime I was told it was not possible to check.
So I emailed them on friday and got a reply today saying there is nothing on the system with my details.
What am I supposed to do now ?? 5 weeks on Im back at square 1 !!!!!
Waiting on the phone now.....looks like I am going to have to resend the form and supporting documents. I just knew this would happen.0 -
Has anyone had any luck getting anything from Flights and Packages due to the Goldtrail failure. For 5 weeks now they keep telling me I will get a CAA form for the flights element and a refund for the hotel elements of our holiday minus a £78 cancellation fee!!! So far nothing despite the fact that I have emailed the owner.0

I contacted CAA who run the Atol scheme and they were less than impressed with Bookable holidays refusal to process Atol forms, unless pre-completed by them, to allow them, to receive the money and charge you for the privilege. The CAA advising me instead to send the form direct to them with a covering letter.
The website posted by Chas (Thanks), suggests this whole episode is becoming more protracted, and companies like bookable are responsible.
I have given Bookable the opportunity to respond first and will post their reply.
Bookable have responded with an email to assure me that if hotel and transfer are used then the £40 fee does not apply (As ponkle22 previously stated) regardless of who you eventually flew with.0 -
I do hope someone will be able to give me some advice. I booked a holiday (for the October school holiday) with Living Holidays for a flight from Edinburgh to Crete with a say at an hotel near Heraklion airport. I have since had a phone call to say that the flight had been booked via Goldtrail and that there were no longer any flights available from Edinburgh but the hotel was still available. I have been advised that there are flights available from Glasgow, however I had previously advised the travel agent the reason for wanting the flight from Edinburgh was due to reasons relating to a disability which makes driving long distances very difficult for me.
I would be most grateful if there is anyone on the forum who could let me know what my position is regarding a refund of the holiday. Agent said that the hotel booking was still in place and that if I cancelled I would have to pay cancellation/administration fees. Would I be able to cancel through my Credit Card (it's a pre-pay mastercard) without having to pay these fees as the holiday is not as I originally contracted it to be. The holiday was all we could afford so not really in a position to lose money over this plus I have hubby quite literally shouting at me to get it all sorted out, I'm getting mega stressed about it all.0 -
Living Holidays appears to operate as an agent, not a tour operator. This means they should have sent you a copy of the booking confirmation from Goldtrail for the flughts and someone else for the accommodation. If they did this correctly, you have two separate contracts and although you can claim from the CAA for the loss of your flights, you will still have a valid contract with the accommodation provider for the hotel. This means you can only cancel according to their terms and conditions, and since the accommodation is still available, you cannot claim from your credit card provider as there is no breach of contract. This is the big problem with following advice to book a holiday in separate bits, yes you may save momey but when it goes wrong, as here, you are left with half a holiday.
Your only hope is that Living Holidays didn't act correctly and only issued their own invoice showing a single price for the whole holiday. If that is the case your contract is with Living and if they cannot find an alternative flight from Edinburgh they must offer you a full refund. If they refuse to do so, and say so in writing, then you can make a claim under the Consumer Credit Act as they would be considered to be unwilling or unable to provide what had been promised. All I have is an email which shows an invoice total for the holiday plus the credit card charge, there is no breakdown showing the separate costs of the flights and the hotel.0 -

I rang the CAA last week asking when i`d get my refund. He said "Dunno, you`ll just have to wait" :mad:0

To L6MCT, you seem to be on to a winner there, there is no contract with Goldtrail, only Living Holidays so you must insist they find you an alternative flight or give you a full refund. They are members of the Travel Trust Association, not ABTA, but it would be worth talking to them, they are based in Woking, if Living try to give you the run around. The CAA announced last week that they would be refusing a lot of claims submitted simply because agents had not disclosed who the bookings were with, although they didn't release the names of the companies. I suspect many of them have already been named on this forum.0

I contacted Purple Holidays earlier in the week to see if they could confirm that they received my claim form, I have just received this reply:
"[FONT=Tahoma, Verdana, Arial][FONT=Tahoma, Verdana, Arial]Please be advised that I are waiting for the claim form and you can contact us the next week to be informed if you have receive it.[/FONT][/FONT]"
I'm beginning to think it will be a miracle if I see any of the money back!0
