Do any of you know if it is in Royal sun alliances terms and conditions that because she has been convicted of drunk driving they will refuse to pay for the written off Motability vehicle?????
Usually it is a clear breach in most car insurance policies but perhaps there is a special arrangement between RSA and Motability due to the volume of buisiness Motability gives RSA.
It would be interesting to see if anyone on here has access to a copy of RSA's Terms and conditions and any exclusions for driving a Motability car.

If she is driving the new vehicle, you can anonymously report it to MO's Fraud and abuse team, if you think she has not disclosed the conviction you can also ring RSA with the reg and their fraud team will look into it.0 -
I still don't see how she could have put in an order for another vehicle from Motability just 10 days after the accident.
They certainly wouldn't accept an order for a second car while the lease on the first was still outstanding. I can't see that the insurers would have settled the lease within 10 days (altho I have no experience of what happens, of course).
Maybe her new car is being held up because motability rejected the order, and the dealer needs to re-submit the order once the insurers have paid up for the write-off ? She may find the order then gets rejected because of the circumstances of the accident (altho maybe not, that's motability's decision).
If the car was taken to a recommended repairer like it should have been after the accident, it would have been inspected and deemed a total loss within a couple of days and Motability would have been paid for the car. It is easily closed within 10 days.0 -
Of course, I had overlooked the fact that she would be disqualified.
Mind you, that makes life awkward in itself. Isn't it quite difficult to buy a car registered in your name, but buy insurance for it in someone else's name?
I seem to remember there being some such question some years ago, when my husband wanted to insure his car for me to drive (but not him).
Motability Operations are the registered owners of their cars, so the hirer can not insure it elsewhere.0 -
arigold,
Thanks for the replies, the are very informative and answer the points raised directly.
By the quality of your information I suspect that you are closely linked with Motability operations or Royal Sun Alliance.
Thanks again.

If you think she has not disclosed the ban or is driving while disqualified, give Motability a ring on 0845 456 4566 and ask for the fraud and abuse team, or RSAM on 0500373737
you won't have to give your name and just get her reg and she can be found.0 -
to have a moblity car is a privilege not a right, and something iam fighting for myslef by abusing that she should lose that privilege and get taxis till her ban is over , really she should be reported i wouldnt expect to keep a car that wasnt mine if i had been drink driving so why should she0

Hi arigold,
Just one more thing, I was wondering why she still has a hired car?
If RSA has payed out for the wrecked vehicle so promptly surely RSA's obligation in this matter is finished.
I must stress that she isn't driving the hired car as she is under ban and must be using a designated driver.
Do RSA still pay for a hired car till she (or her designated driver) picks up her new Motability car which by all accounts could still be a good month or so?
That would mean that she would have had the hired car for approx 3 months which on top of the cost of the wrecked vehicle must be a fair amount of money.
I never thought to mention this about the hired car before.
who pays for the hired car?
Could you give me one of your lovely clear answers to this point please?
