Reporting a private seller on ebay who should be a business. How!

Hi guys,

I know someone who buys stuff at car boot sales to sell on E-Bay. She ALWAYS has stuff on E-Bay selling and quite frankly a lot of people that know her are fed up.

Fed up mainly because she sells all the birthday pressies she is bought on E-Bay. She does the same with her 2 year old daughter's pressies too. Sells them on ebay for a profit and then buys the same thing for literally pennies at a boot sale.

She also stores all the "stock" at her rented house, which must be a breach of her tenancy agreement. We're probably looking at 50 items a month. Sometimes she can make a few hundred pound a month.

I also presume as she is buying stuff to resell it, she should be registered as a business with HMRC.

She has angered alot of people that know her with how she conducts her "business" and we want to put a stop to it.

Advise please?

    Dont buy her any presents?? I have a friend who does the same to make some extra money, good on them i say, i am sure i will not be reporting them to anybody.

    What about it bothers you so much??

    Well apart from the fact that it's against E-Bay rules to buy items specifically to resell.

    I sell clothes that dont' fit, DVD's that we don't watch anymore etc....but she goes to boot sales EVERY saturday and sunday to buy stuff to sell on E-Bay. I sell maybe 2 or 3 unused items every 2 months....that IS a private seller. What she's doing isn't "private" selling"

    She should therefore also be paying income tax on it etc.

    It annoys friends because it's taking the pi*s out of us as "friends". She's been doing it for a couple of years. I wouldn't mind if her E-Bay account was a business account and she was registered as a business accordingly but she actually flaunts to us all how much she's making and that she gets away without paying anything but the E-Bay fee you pay when an item sells.

    Where do you draw the line? If it's ok for her to do it, why should ANY business be registered as a business? They'd all save money.

    And whether intentional or not, I was not after a lecture that it's ok (which legally it isn't!), just information about how to pursue it thanks!

    I would honestly laugh if any of my friends sold something i had bought them, i would speak to them and tell them they would not be getting any more presents from me.

    Have you never bent the rules a bit in your favour, i do not see that she is out to hurt anybody with this, also another of my friends was selling so many things that ebay told them they should register as a business, if your friend gets this and ignores then she can be accountable for what happens.

    I sometimes sell stuff my kids get if its duplicate presents and often I have to relist when they dont go first time - I hope this isnt me!!!

    It's my business because it's some of the stuff I bought her that she has sold! So yes, I have lost out because of her actions!

    If you have given something to her, then it is her's to do with as she likes. If you don't like the fact that she has sold something that you have given her on e-bay, then don't give her anything else.

    You haven't lost out, because once you have given the item away, you no longer have it, and never would have had it again. Whether she chooses to keep it or sell it, doesn't mean that you have lost anything, although you may be a bit miffed at her ingratitude - but as I say, don't buy her anything else in that case.

    It is not against e-bay rules to sell an unwanted present, that falls squarely within selling personal items that belong to you, and is permitted.

    I think you are understandably upset that she has be so ungracious, but deliberately setting out to get her into trouble with the tax man seems to me to be OTT.

    Just my opinion, apologies if you don't like it.

    Come on, your friend is much more attractive and successful than you, and that is what is getting your back up! :beer:

    You haven't lost out because of her actions, you lost out when you gave her the items. They were then gone from your possession , so you had lost them.

    It would have made no difference to you if she'd given them to a charity shop, thrown them in the bin or burned them in the garden, you would still not have them.

    If you were a friend you would simply have a word with her, not shop her behind her back.

    I'm so glad I don't have friends like you, life's hard enough without those you regard as friends sticking knives in your back.
