    I know it can be a drag, with one of mine I must admit I know it will be a long old haul and even longer to be resolved, as its in relation with the insurer/underwriter, its been with the fos since last October, so just over a year now, and not so long back allocated with a adjudicator, however, I am just letting them get on with it now as I am unable to do anymore on this one, and just hope for the best.

    Nanna, you do what you feel is best for you honey, I know it feels like your not getting anywhere at the moment and with the constant forms, I can understand it can get us all down, maybe give yourself a timescale then have a think about it if you feel your unable to get anywhere on this one, but nanna that is up to you of course.:A

    An update
    Sent complaint re aviva letter still waitng to hear from FOS.

    Sent to FOS Citi complaint they were supposed to have cancelled the policy in 2008 and are still taking payments FOS letter today AND ANOTHER FORM.

    Right fresh query ( i am a pain i know)

    I complaind to capital one about their ppi they have taken time to answer but cqme back with this reply

    "When you applied for the card you ticked the no box for the cover. 3 aug 2001.Then when you rang to activate the card 19 sept 2001 during a telephone conversation you activated it"

    then they give my age at the time, address and salary. They confirm that they sell ppi on anon adivised basis.

    Any hope do you think:)

    Hope your well, and thanks for your update, good luck there.

    And your not a pain.:D;).

    They must still have proof to provide on this then nanna, if they have disclosed those details, they must still have them, so it maybe worth you asking them to send you details of this.

    If they say they are unable to then why say that to you as above? if you know what I mean. So wonder if they still hold a copy of the telephone conversation perhaps??

    You could request a SAR nanna, but it costs £10 cheque or a postal order payment, but if they cannot provide them all of a sudden they they contracticted themselves.;)
    So yes it maybe worthwhile.

    Hi Nanna

    Hang in there with Capital One as I had quite a few letters back and forth. When I eventually threatened with the FOS they coughed up and cleared my balance but no 8%. I was just happy to have the debt cleared.

    Don't give up and keep following Di's good advice.

    i do not think that the details matter that much from them as they would have had them when i took out the card

    What aload of old tosh!!!!. If you ticked the no box then no is what you meant, tell them that when you phoned to active this card, why after ticking the no box would you then say yes to the person who activated your card?, this is a ploy when you activate your card as the person is in effect "selling" you this product after you ticked the no box. It must have been made "to be an attractive proposition" for you to "change your mind". Tell them you would like a copy of the telephone call where the person who activated your card says
    " would you like to take ppi with this card mrs smith?" and mrs smith said "yes please".Put you money on it they wont find this.

    then they give my age at the time, address and salary. They confirm that they sell ppi on anon adivised basis.
    They will know this info as these are the details you gave when you applied for the card.If this was a non advised sale,what was said to you when you took ppi after saying no, to make you change your mind?. Write them a letter and tell them that you did not want this ppi and ask for the telephone conversation from the day you activated the card as you are curious as to what made you change your mind concerning this ppi when you had already declined it. As you believe that this was an advised sale as there cannot be any other reason for taking this ppi other than being given reasons as to why you should take it by the person who activated your card. Say that if they dont reply within 8 weeks you will go to the fos and get their opinion on this. You only need a few lines (hope i have helped you with what you should put) Do it today, will only take a few moments and a totter to the post box (recorded). This will make them move i believe, as i dont think they will be able to prove what you and the operator said to each other. I, and i am sure many others have phoned to activate a card and ended up taking ppi, at the end of the day this is a sales pitch and i dont believe otherwise.
