    "When you applied for the card you ticked the no box for the cover. 3 aug 2001.Then when you rang to activate the card 19 sept 2001 during a telephone conversation you activated it"
    What aload of old tosh!!!!. If you ticked the no box then no is what you meant, tell them that when you phoned to active this card, why after ticking the no box would you then say yes to the person who activated your card?, this is a ploy when you activate your card as the person is in effect "selling" you this product after you ticked the no box. It must have been made "to be an attractive proposition" for you to "change your mind". Tell them you would like a copy of the telephone call where the person who activated your card says
    " would you like to take ppi with this card mrs smith?" and mrs smith said "yes please".Put you money on it they wont find this.

    then they give my age at the time, address and salary. They confirm that they sell ppi on anon adivised basis.
    They will know this info as these are the details you gave when you applied for the card.If this was a non advised sale,what was said to you when you took ppi after saying no, to make you change your mind?. Write them a letter and tell them that you did not want this ppi and ask for the telephone conversation from the day you activated the card as you are curious as to what made you change your mind concerning this ppi when you had already declined it. As you believe that this was an advised sale as there cannot be any other reason for taking this ppi other than being given reasons as to why you should take it by the person who activated your card. Say that if they dont reply within 8 weeks you will go to the fos and get their opinion on this. You only need a few lines (hope i have helped you with what you should put) Do it today, will only take a few moments and a totter to the post box (recorded). This will make them move i believe, as i dont think they will be able to prove what you and the operator said to each other. I, and i am sure many others have phoned to activate a card and ended up taking ppi, at the end of the day this is a sales pitch and i dont believe otherwise.

    Had a reply today with regard to sending the above letter to cap one."they are dissapointed to learn i am dissatisfied with their response they maintain that the ppi was not missold they cannot provide a copy of the tele conversation and will not be refunding."
    They have sent a copy of the original leter from them an say it forms part of the final response.
    Any advise as always gratfully needed.:):)

    Still battling with the FOS with Citit complaint and Aviva ( had more forms) sent off again. nothing more on these yet.I feel i just want to get someone by the throat and shake them cos it seems to me that the reason i keep having to fill in forms is that it takes so long they delete details and i have to start all over again. xxx

    some time ago my husband had a ppi with Lloyds TSB when he was put on short time thy yold him to cancel as he did not need it.Now he is out of work can he try and claim it back and should he have been advised to cancel?

    Hi nana, As the ppi is cancelled i am afraid that you cannot claim on this now.It was cancelled due to the fact your hubby was not eligable to claim on this, you could put a complaint into lloyds and say you were mis sold, as when your hubby went on short time working you were advised to cancel this insurance due to not being able to make a claim at that time.And it is because of this that you believe it was mis sold.

    Hi nanna, as this is a final response, you need to take this to fos. I know it means writing another letter :mad: but cap one will maybe hope that you dont bother taking this further :mad:. At least if you take this to fos and they say no, then at least you will have tried x.

    Hope your well.

    I would do what amersall suggests, by putting in a reclaim on the PPI of what your hubby did actually pay into ppi and interest, if he was not eligible and you cancelled this product, then you can still make a reclaim on what your hubby did pay into this.;)

    However, this means yet another reclaiming questionnaire......:D;)
    Remember nanna to save copies of what you send to lloyds and what you receive ok, this is just in case you need to go back to this at some stage.

    you are very welcome :D please dont give up !! i know sometimes it can feel like you are getting nowhere, but at the end of the day this is your money, and if you can get it back then do it. The banks hope that people will get fed up with all the forms etc and just let it go, they think we are stupid x.
