Im trying to get my head around it...this is my understanding (with bad drawing!)
Red cars are parked at side of the road, blue cars are tucked in waiting for the lights to change so as not to obstruct the carriageway. On the lights changing OP's car has to edge out past parked red car, but Over Takers car (Green OT) has already started overtaking the line and crashes into the side of the OP.
Is that about right?0 -

thats my interpretation of it LucyLucky, I could be totally wrong though! A similar thing happens at the end of my street, cars double parked and if there is a queue for the junction you have to tuck in and wait.
If that is what happened I'd agree the girl was incredibly stupid, but I think a court would rightly argue you should check your mirrors before you pull off.

lol no, move the parked cars to the right hand side... 5 of them nose to tail. Me and other traffic pulled over to the left (to allow room for oncoming cars), car infront of me is 3/4 on the path, his intentions are unknown, but there's no room in front of him so assume he's queued too.....
At the very far end of the parked cars we have a van which is appears to be coming down through the gap we've left towards me.
After 4 seconds the car in front of the pavement car moves on, I indicate that I intend to go around the pavement car (but it's only just on the road).
I check my mirrors, ive got a yellow car behind me who's not pulled over to the left as he's not opposite the parked cars, I don't see anything else so I move on. Daft cow comes flying past the car behind into straight into my blind spot and despite my indications carrys on straight into my car.... I'd stopped for exacty 6 seconds in total. It took her 2 seconds or less to get around the car behind and to get along side me.
6 seconds, ive timed it.... She was easily within a distance to see that I had not parked and that I was infact waiting for the road to clear. She was trying to overtake a total of maybe 8 queued cars, which she thought were all double parked.......
Now I don't know why i've bothered to explain this, it's only going to get ripped apart out of all context....
As mentioned above, the highway code states DO NOT overtake:- where traffic is queuing at junctions or road works
- when a road user is indicating right, even if you believe the signal should have been cancelled. Do not take a risk; wait for the signal to be cancelled

Thats clearer! And I see your point now. How much does your video show?
Must confess I did not know that was in the Highway Code (no excuse really, especially as I have been rereading with DS for his theory) but it is common sense isn't it?
On paper I'd hate to call it, and I could see an Insurer taking the 50/50 option, however if your video is clear....0 -
Does your camera have sound?It would really help back up your account with the insurers as you'd hear your indicatrs ticking.
I personally think its the womans fault.She overtook waiting cars and caused the situation to arise.Strider says he checked his mirrors and that going to be hard to prove either way(I am not implying you're lying).It would be quite rough justice if he had to share the loss in ncb really.

Nope, car directly ahead (on the path) drove off very quickly after the impact (probably felt partially responsible), but I have their plate on the video... cars behind all U turned. Hmm 'if' you were indicating (which you haven't yet clarified) then i guess she was in the wrong as i know exactly what you were doing..if you weren't then it was up to you to check no 'daft bint' was coming down the side of you! At dd's school this happens often as people just sit there and others think they are stopped or parked or whatever! They zoom down the side so i am always very wary tbh and indicate..still doesn't stop some dumb people though!0

Ah well you were doing quite well on the sympathy front until you decided on the unnecessary and unfounded racism.
Very impressed that every car behind you managed so quickly to do U turns in such a tight space.

Lucky, he already said that there were cars parked on the other side of the road and when he moved over there was enough space left for oncoming traffic to pass so it seems the road was wide enough for 3 cars.I presume the cars behind u-turned because the 2 cars involved in the collision blocked the road.
He could be leader of the KKK and I'd still expect him to be entitled to the same "fairness" as anyone else when involved in incidents like this.0
