Tesco misprice policy discussion area part 8

just come back form tescos... as there were mobile phones finishing on the 3rd.. but no... their are on the ball at mo... the sel were changed in 3 stores i went to... so maybe with the xbox console thing going round at mo.. the stores have been told to pull their socks up on the sel's....
also just out of interest for people.. with the games sel's. its the first picture...of the sel.. thats in the stores that i have visited....
i know this is totally off thread..... but its a sad day for me hearing about steve.. irwin..... one of my heros's.....
so ...it just brings things into prospective for me... life is to short.. and we dont know what's going to happen tomorrow.... so live for today.....Work to live= not live to work0 -
The Tescos at Brent Park has added on a line under the "If things dont add up" to effectively mean that R&Rs are "not applicable on Special promotion items"
I wrote to the customer services with a copy to Terry and today received a reply from Customer services asking for my name, address, telephone number so that the store can reply to me directly. Is this usual when a complaint is made ? I have no probs in giving my details but I cant understand why they want all these details as they can reply via email.I have learnt that living life to the fullest gives you a much better high than alcohol or drugs !0 -

Ive seen this there too. Its from one of those labelling machines that they've stuck on. Its complete rubbish.I just ignored it. If they try to use it ask who put it there as they are breaking Tesco policy.

In my local store the "Game of the week" was still Prey, the poster was a chart of the top 15 games or the like. This was dated 18/08/2006 at the top.
I then purchased the xbox and game of the week and it didn't discount the £20 (this was Saturday 2/9/06). I then proceeded to the customer services desk and politley asked for my console and also told them I was overcharged.
The C/S rep walked with me to the shelf and agreed that there was an overcharge. She said that she would refund the £20, so I asked her to check as the signs were ambigious. She got the manager. He then said that it was £20 off the game, but after I got him to check the yellow sign he agreed that it was ambigious and would check with HO. I pointed out to him that it needed to say "on Game" on the yellow ticket for it to be correct under his argument (or just get them to cut the loss to the game).
After about 20mins, he came back with console and game and said "Happy Christmas" I got the r&r for the bundle.
I think as the other posters have said, that the problem is the game of the week chart, which isn't being updated, but Head Office are updating the tills.
I would like to thank posters on the site otherwise I would have settled for the £20. As although I shop at Tesco, I can say I never read any of the marketing at the tills and never took notice of the information signs until I found the site.£2 savers club = £52 - spending money for holiday0 -

None whatsoever but I thought it was a bit cheeky to ask. I am going to send a reply with all my details and a rant about why they need it
BTW - Have you had any luck with R&Rs at this store ? I had only 53p for the past 4 weeksI have learnt that living life to the fullest gives you a much better high than alcohol or drugs !0 -

Yeah I got a £90 r+R there on DS games last week, although they didnt know what they were doing...there were junior members of staff arguing amongst each other over the r+r decision the mnagaer gave and telling them i shouldnt get it! I ust stood there quiet and eventualy i got it...it was a mess though!0 -
I think this is interesting: RE: being asked for your name and address upon receipt of an R+R.
Under the data protection act 1998, processing of data may NOT take place unless AT LEAST ONE OF THE FOLLOWING CONDITIONS ARE MET:
1. The data subject has given his consent to the processing.
2. The processing is necessary-
(a) for the performance of a contract to which the data subject is a party, or
(b) for the taking of steps at the request of the data subject with a view to entering into a contract.
3. The processing is necessary for compliance with any legal obligation to which the data controller is subject, other than an obligation imposed by contract.
4. The processing is necessary in order to protect the vital interests of the data subject.
5. The processing is necessary-
(a) for the administration of justice,
(b) for the exercise of any functions conferred on any person by or under any enactment,
(c) for the exercise of any functions of the Crown, a Minister of the Crown or a government department, or
(d) for the exercise of any other functions of a public nature exercised in the public interest by any person.
6. - (1) The processing is necessary for the purposes of legitimate interests pursued by the data controller or by the third party or parties to whom the data are disclosed, except where the processing is unwarranted in any particular case by reason of prejudice to the rights and freedoms or legitimate interests of the data subject.
If you refuse to give data condition 1 is not met.
I cannot find any terms and conditions of Tescos that would constitute a contract for the r+r policy, which state that name and address must be provided, so condition 2 is not met.
Condition 3 is tricky…I have so far not found any UK law which states that all shops are legally required to obtain a name and address of the customer when a refund is given. Although there may well be a law that states this…please let me know.
'Processing' means obtaining, recording, holding, organising, disclosing or using the data.
If they claim you are breaking the law (as has happened to some people), then any information they request from you is classified as 'sensitive personal information' ("data consisting of information as to the...alleged commission by him of any offence") Sensitive personal data must be handled in a much more stringent way, so to do this they would be opening up a whole can of worms for themselves.
If Tesco holds any data on you, you have the right to ask for what purpose it is being used, how long it will need to be used for, and what security measures are being taken to prevent unauthorised use of or access to the data.
So as long as there is no law to meet condition 3 above:
The bottom line: You don’t have to give out your details if you don’t want to!0 -

under UK law: "The seller can't get away with notices saying there are no refunds on sale goods.

so they have to refund you (in exchange for the product)...they are not legally obliged to do the R+R though.
But is still against Tesco national policy to change the sign like that.0 -

I disgaree with you though. Think of any goods or services you pay for. Any policy or terms relating to that good or service ARE a right, not a privelidge.
If you subscribe to a DVD rental company and dont receive any DVDs you wouldnt just sit back and say 'oh well...you win some you lose some' would you? It is your right to receive them!
An analogy for this is to witness a car accident and the purpotrator bribing you not to be a witness so he doesnt have to pay up on the insurance. You both get a good deal, but what about the victim?

Tesco have to be commended for offering such a fantastic policy in the first place, BUT, people, like yourselves, plainly abusing the staff and throwing your weight around just spoil things
at the end of the day, Tesco didn't have to offer this policy, but, deliberatley 'mis-interpreting' offers to obtain goods for free is abusing the system, it's selfishness, plain and simple and WILL result in tescos cancelling it for EVERYONE.
for the xbox thing, you have implied that you have already had one xbox + game for free, which was a 'bizzare' set of events in itself, a core system has always been £209, a premium £279, so, not certain whats gone on there, unless someone's put a premium barcode on a core box
so, why threatning legal action, etc, when you can't get a second xbox for free?
it's not a matter of wrong or right, i'ts a moral thing here, if you try to get a freebie and fail the first time, then ring head office, if you then fail, walk away, legal action will not help anyone in the long term, at best you'll get a free xbox and a few quid, at worst, no-one will ever be able to get R+R againmoney saving my @rse.
I've spent 10x as much as I would if I had never discovered this website :-)
