now you are making an open offer to buy an item, at no point are you 100% sure it won't scan at the SEL so I don't really see the deceit or dishonesty (and it would be v hard to prove otherwise), however the Tescos store when overcharging has used deceit to gain more money than the advertised price - next time you get accused of fraud tell them that and insist they call they cops0 -

explain how you were seen on the cctv system using the self scan machine ?( not u in person ) ( and if you can find one that works)

How about, i read your posts on MSE, defined you as an active RR, have proof you posted x amount of times proving intent ? and have cctv of you comitting the act at X amount of different stores ?
If or if not, T has deeper pockets than anyone posting here, and if they dig their heels in you won't win.

So can we be clear here? If you go to Tesco CS desk and complain that you have been overcharged for something, are you committing an arrestable offence? Perhaps we should write to Tesco's lawyers and get a clear statement as to their opinion?
If this happens to me I would VERY DEFINITELY:
a. Refuse to leave the area of the CS desk
b. Demand my R&R
c. Contact Trading Standards and make a formal complaint
d. Contact my solicitor on leaving and issue a writ for unlawful arrest.
Unfortunately the Tesco I use most (in Aylesbury) has removed all customer scanners, and there are NO SELs for any of the items being discussed here (games mainly) so you have no idea until you pay whether they are going to scan correctly or not.
All of the GBA games in Aylesbury though are stickered at £xx.94p so if the do scan at £xx.97p go for themYou don't get medals for sitting in the trenches.0 -

And how many times have people scanned something on one of those and it has ahd the discount at the till? More than once - so how is Mr T going to get my name and address from me posting here? From just reading he can't get my location let alone name. If he does get any further information it will be by some illegal means. As for committing the act at X different stores, well I don't r&r that often and don't abuse it by buying 20 games etc maybe just a little more things than I would normally. To actively have recorded me and wasted that much time tracking me down - I think head office might have something to say about that managers future. £100k wage ~ £50/h viewing video footage and tracking my steps with enough proof ~ 4hrs wow I got £5 worth of bacon free and they've waste £200 and had shed loads of bad PR. Thats deffinately worth it - I can tell you're a high ranking business exec.
If I was to be prosecuted (or Tescos for that matter) for fraud it would not be myself or Tescos doing the prosecution - ITS A CRIMINAL OFFENCE therefore the depths of my vs tescos pockets wouldn't really come into how I was treated by the CPS and court system. Unless you are suggesting that Tescos would be bribing the CPS, Jury and Judge?
My statement was purely a suggestion on how to turn the nasty accusations the other way round - if you don't like it you don't have to use it but there is no need to be rude - especially when you are wrong.0 -
Point is, how far are you willing to go to prove you are right ?
You may well be right and entitled to a full RR with out any imtimidation or harassment because of T's incorrect pricing.
Pushed this would happen to avoid bad press.
How far do you want to take it ? They can afford to take it all the way, can you ? And do you need the extra hassle and stress in your life of taking on a giant for the sake of 43p ? ( not you personally, using as EG).
Sometimes wonder if people used the amount of time and energy on research, positive, legal, sustainable enterprises, they could do very well for themselves.

I'm not threatening to sue etc here - I just would love to see the look on the managers face after they accused me of fraud if I said
'well as I see it I've not been deceitful and I don't see how you can prove it. Whereas this store by leading me to believe a certain price is valid and then charging me more has been deceitful, proffited from it and therefore have defrauded me - what do you have to say about that mr. manager?'
think they may shut up v quickly - you will still end up barred, but would be funny to see the guys face0 -

at the end of the day, you're going AGAINST THE NATURE OF THE POLICY by deliberatley seeking R+R
I get loads of them, and stll do, i've been banned from a couple of stores also, I don't complain though, it's a cat and mouse game, i've been refused BG R+R's, i've won many BIG R+R's also, and 1000's of smaller ones too
at the end of the day if you're unable to mask your activities sufficiently to the point where you get noticed and banned, tough luck!!
please don't start spouting legal crap everywhere, or, as always, the few will spoil it for everyone else. I already limit my R+R posting on these forums due to the number of cranially lacking idiots around :-(, a classic example of which being in a post abovemoney saving my @rse.
I've spent 10x as much as I would if I had never discovered this website :-)

I was the one who started this debate with my story, i don't really feel that i've moaned or whined, i do feel that i had a bad experience at the hands of the tesco mafia though. As i've said i'm not particularly bothered about being caught or banned from said store, its the risk you run and im not the first or won't be the last to do so, but i did have a problem with them spreading my picture and fake details about as i felt this was a breach of confidentiality. In the end, afterall, i was never charged with anything and i feel that, in hindsight, if they could have got the police involved they probably would as they would with a shoplifter.0 -

There is NO WAY they would have got the police involved in your scenario! The police would have laughed at them (or even better accused them of wasting police time!) They were just trying (successfully!) to put the frighteners on you. I know hindsight is a marvellous thing but I think the main lesson to learn from this incident is NEVER to be allowed to be taken away from the CS desk. Let the argument commence in FULL VIEW of other shoppers as I think you will find their accusations will be a lot less damning than when they have got you in a private room!I spelt my username wrongly on purpose, by the way!0
