Sorry I must add my tuppence worth.
Things get lost in the post, it happens I have periods where I can lose 1 in every 100-200 packages I send, it doesn't mean I am stealing from my buyers it just means that the RM have let me down.
However, your seller was quite wrong to say it was nothing to do with them, the fact that there are still sellers out there that believe that is true is why I always advise people to use paypal and paypal only, backed by a credit card. That way the buyer can start an chargeback if the seller refuses to refund voluntarily.
Personally as a seller if I have a buyer tell me their parcel has not arrived I iwll politely ask them to wait until the second week, then I willr efund them in full and without resorting to name calling. After 15 working days I will merely reclaim my loss from the RM, it doesn't have to go anywhere near a chargeback.
As a buyer, if something I buy does not arrive I would politely inform my seller. Again I would expect a full refund within say 2 weeks, and luckily so far all but one of my sellers refunded immediately.
The certificate of posting is for the sellers benefit not the buyers and paypal only take proof of delivery to stop a chargeback, and where delivery can not be proved will always find in favour of the buyer.

Soo
I have to agree with Soolin on this one. The seller is responsible for the item until it reaches the buyer it doesn't matter if they have proof of postage.
There are many eBay sellers that put as a term in their auctions they are not responsible for items lost, as although they send items untracked, they obtain proof of postage.
This is an unenforceable terms and as such doesn't mean 2 biscuits, Paypal and eBay would disagree that they are not responsible and would force them to refund.
Bottom line is: if a seller sends untracked and it never arrives (or buyer claims it never did) then they will probably have to refund, either voluntarily or though a Paypal claim. If freedom is outlawed, only outlaws will have freedom.0 -

not down to the OP to do this - its up to the seller to get the item to you, the seller should take it up with the post office.
in the meantime, a paypal dispute is the correct thing to do and as they didn't receive the item, and the seller has no proof they did, they will rule in the OP's favour.0 -
paul&nat wrote:thanx all 4 ur advice im just gonna wait ans see what happens with the claim on paypal! then wont get anything else off that site again its nothing but trouble for me! thanks again

by that site do you mean ebay? if so i wouldn't let this put you off.
stick with established sellers and pay via paypal and you won't go too far wrong.
Buying off ebay can be like buying from some bloke down the pub, so you have to be careful.0 -
yeah i meant ebay, but if this did happen again i dont know if i will get my money back for this. if i do then i will use again only through paypal though.
thanks alot for all your advice
look forward to gettin my £4.50 back!
also a 2 pack of dummies does not cost £1.50 postage on a standard post so i have been robbed there if not anything else!!0 -

Robbed? I'm sorry but I think you are misunderstanding how ebay works. If the post and packing is shown on the auction then you've agreed to it, full stop, no one can rob you if you voluntarily agree to something. Also, with the new Posting in proportion have you actually sent identical items to see whether they are a package or a large letter? I would rather assume from the size that they will be a package with a minimum charge of £1 for postage alone even before packing.

ASk for the certificate of posting, you can then claim off Royal Mail. If they refuse to send it to you, or to provide electronic proof, then complain to e-bay.April Grocery Challenge £81/£1200

a pain i know, but as a seller, i always send the item recorded and include it in the price.
Yes you can - as the seller, you post it at a post office and get a certificate of posting. It covers you for somewhere in the region of £20 worth of goods. I always get one, regardless of what I'm sending, as it covers your back as a seller...April Grocery Challenge £81/£1200 -

Exactly, it covers you as a seller, it is meaningless as a buyer. Why advise the OP to claim from the RM when the RM will deal only with the seller who actually sent the item?
Oh and a COP covers most, but not all items up to £32. Noticeable exceptions being cash, some jewelery. vouchers and tickets.
