    spl2nh,

Just wanted to say, good on you for admitting to it and not trying to wriggle out of it! There are several posts on here where people know they were driving when they were caught speeding but try to find any technicality they can to get out of paying.

Thank goodness there are other people out here that think honesty is (nearly always) the best policy! x

    Hi,:)

I've just noticed this post, and thought you could help. I don't drive, but hubby does, and he's been told that you can see when you're caught by a speed camera, because such cameras always make a flash when they take pictures. Is this true? Is the flash a reliable indicator (the only one?) of your being caught? How can you know for sure?

    Thank you:A

that isnt strictley true, i had gone through some traffics on amber on a roundabout and as i went round the corner i saw a flash and i thought i had been flashed as i went thru but what happened was as i went thru another car had gone thru on red and got flashed,

the flash is an indication the camera took a picture but as to who it took one off you wont know, give it a few weeks

  • 70-100mph on mway and you'll get 3 points and £60 fine. More than 100 and you'll probably go to court.

In reality, you're extremely unlikely to be caught doing 70-80mph. Your car speedometer will be set around 3/4 mph higher than you're actually doing, and speed cameras (particularly mobile ones) have a "buffer zone" of about 10%. Basically, if your current speed is Speed Limit + 10% + 3mph, you're in danger of being caught. In a 30mph zone, that's around 35/36mph, and in a 70mph zone it'll be 80/81mph. However, you may well get a letter saying you were doing 31mph/75mph - you probably were. Your speedometer tells you you're going faster than you actually are.

  • If you're the registered keeper of the car - as opposed to the owner (they can be different people!) - then you are required to identify the driver of the car. If you fail to do that you are likely to be prosecuted under s 172 of the Road Traffic Act for failing to identify the driver: unless you have a VERY good reason for not being able to do so.

If it was a camera van then the - up here anyway - van is equipped with 'laser sights' that can pick out a vehicle up to about a kilometre away, track it and work out the speed and take a photograph of the driver FROM THE FRONT so when the photograph comes through the door it's your mugshot sitting behind the wheel of the car... If there was no flash, which with these vans there won't be, it doesn't matter. The photograph will have been taken as it's all digital.

The registered keeper is required to have a NIP served on them within 14 days of the offence. The service is complete when the NIP is sent to the keepers address as per DVLA records. Moving house, sending it back, etc (to my knowledge anyway) is irrelevant. The service is complete as soon as it is sent and arrives at the address DVLA hold for the registered keeper. Also, the 14 day rule can be overcome if the keeper is "making themselves uncontactable " if you know what I mean and the prosecuting authority is doing everything it can to trace them. In that case, the court may deem that the PF or CPS has done everything it can to trace the keeper/driver and may not throw it out just because NIP wasn't served.

A lot of twisting and turning just to avoid the points or fine.

I once had my speedometer calibrated on a rolling road and it did indeed overread at all speeds. Results were approximately
    real speed / reading
    20 / 22
    30 / 33
    40 / 44
    50 / 54
    60 / 65
    70 / 76
    80 / 86
    90 / 96
    100 / 106
    110 / 116
    120 / 126
    130 / 136
    140 / 146

Tom - some interesting findings there, and pretty much the same as I've heard in the past. Still, as far as speed limits are concerned, follow what's on your speedo!! Don't risk it!

With regards to the 10% + 3mph thing, that was just the ACPO guidlines.
Anything over 70mph is exceeding the speed limit.

    Current ACPO guidlines are:

Speed limit > Fixed penalty > Summons
    20 > 25 > 35
    30 > 35 > 50
    40 > 46 > 66
    50 > 57 > 76
    60 > 68 > 86
    70 > 79 > 96

  • I went on a speed awareness course at a cost of £60 and no points when I was clocked doing 34 in a 30 limit by a camera. It took a total of 9 letters back and forth to find out the driver book and take the course etc !
