    Tell the card issuer that FSA Rule BCOBS 5.1.11R says

    "(1) Where a banking customer denies having authorised a payment, it is for the firm to prove that the payment was authorised.

    (2) Where a payment from a banking customer's account was not authorised by the banking customer, a firm must, within a reasonable period, refund the amount of the unauthorised payment to the banking customer and, where applicable, restore the banking customer's account to the state it would have been in had the unauthorised payment not taken place."


    and that if they do not want to comply with this rule they must refer the matter to their complaints procedure - and that the FSA rule book also makes clear that you do NOT have to put your complaint in writing.

    If you don't want to take the compliants avenue, another approach along the same line as above is:
    1) Call the dispute or fraud department and have them chargeback the transaction. Barclays is the clearing bank and are aware of the problem.
    2) Force the issue since Cornwall collections or loan centre will need to provide proof of acceptence after Barclays does their standard representment.
    3) If your bank does not chargeback and credit your account by the close of that business day, or the next if the request close to the end of the standard business day, then request written comfirmation.
    4) Write directly to the FOS concerning the firm non-compliance to the PSD. FOS will refer the case back to your bank for initial resolution, but at least it will be taken seriously.

    The only other avenue I have previous seen work is an online CCJ filing. For this you would agree a contract was enter into (which I don't think it was, but that is only my opinion) but you have 14 days cooling off period. Since they are not refunding your money you can file the CCJ for the funds plus the court cost plus your time and effort. Breach of the Distance selling reg. is clear so should be a clean case.

    they tried to take over 400 yes 400 quid from my account over 2 days, vie never heard of theese di*k heads! but i will have my revenge on the idiots.

    I suppose they wont be refunding me the money for the phone bill that has been caused by me having to ring up Barclays premium line for over 2 hours to find out !!!!!! is going on, and no im left with no card ( as it had to be cancelled) and a !!!! load of Fraud investigation paper work to fill in, thanks allot Cornwall collection, You useless c*:mad:nts!

    You know can't believe that both Nostrum (Cornwall Collections) and Barclays (who are merchants for them) are helping these con men, isn't that assisting in a crime???? They seem very aware of whats going on too and its getting absolute pathetic (trying to think what to say without swearing)

    Started to query the Mr Carter that 'wrote' on this forum, I have found a reply from him on another forum and he seems to know alittle too much on how this company trades to say they only act as a collection for them.
    A letter my bank has received from them has a section - date and amount of refund....... so these can be done if they wanted to.
    I can't understand why a company would carry on trading with a company that is giving them such a bad name - which it is, as it is this company that shows as collecting the money and which is been mentioned on here. Really beats me, probably because they're getting a % of the money collected and as its been taken wrongly its easy money for them they're as bad as the Loan Centre. If they were really bothered they'd try to help and not give crap info that gets people nowhere which is readily available, don't they think people wouldve tried this. As they are customers surely they will have alot more info than they're letting on.
    And where is it decided on how much will be taken, Loan Centre or Cornwall Collections as theres nothing on the site about fees and people are having various amounts taken, think someone must get up and think oh today we'll take £50, wake up another feeling crap oh today we'll take £400 I need a new coat its probably a game to them all and both the collections and centre probably sat laughing. You look on the press release part of the site,I wonder who the 3 new lenders sign up article is about because it won't show on the web as unavailable now

    I would suggest a quick look at the Nostrum Group site, they provide a service that I think we all want - Debt Recovery

    Totally pathetic and they are providing willingly and knowingly a service to a customer who are fraudsters
  • Had the same problem with these guys. Had £47.50 taken out of my account and was told by my bank that they did not know who was taking the payment and that I couldn't cancel the payment as they had my full card details. Went back to bank of Scotland the next day after cooling down and spoke to a different manageress who told me that it was Cornwall Collections but didn't have any contact details for them but googled them and showed me the huge amounts of complaints. She also told me that they had been trying to take the money for 4 weeks but the bank had delayed payment as they knew of the dubious nature of the company. Have since found that they were acting on behalf of The-Loan-Centre.net who I apparently subscribed to on 08/09/10 which I never. have emailed the loan centre repeatedly in an attempt to get a refund and have been told that I can get a full refund if I cancel within 14 days of subscribing, only received the email stating that about half an hour ago, here it is. this the fifth in 2 weeks after me sending numerous emails to them saying give me my money back. I'll let you know how i get on.

  • 08707542310 appears to be a contact for loan centre but claim not to be the company, although they could see the payment for 61.50 and have written a email off to the "company" to request the moneies be returned and to contact abb on her mobile. Advised them that I have complained to the ombudsman.

    I have had £61.50 taken on 21/10/2010 and they attempted to take £1400.94 on 23/10/2010, so did a bit of digging and here it is. You need to contact the financial ombudsman the company name is loan-centre.net and they are only online.

They stated they would write an email off to the company "loan-centre" to request the money be returned and they would ask them to contact me. Within 10 minutes the company contacted me and said they would look into it I advised them that I have complained to the ombudsman and would be contacting the police. The man who contacted me was HARRY WILLIAMS he claimed to be the manager and immediatley offered to send a check I didnt want to accept a cheque but he insisted and said he was helping me. I asked for compensation to cover the trip to the bank, the 0870 phone calls x3 but was TOLD I could only have a cheque. He stated that they are a brokers, people pay 61.50 for membership and are provided with lending details There is no direct contact number other than the above that I searched for, but there is an email address that HARRY WILLIAMS gave me [EMAIL="harrywilliams&#64;loan-centre.net"]harrywilliams@loan-centre.net[/EMAIL] (remember he claims to be the manager.)     Hi there is a samuel williams who is director, have a look on p1 of this and I found a credit report which tells you directors, etc.
    Load of crap isn't it about the fee various people have had different amounts and it says nowhere about this amount.

    ABI on another forum on here about this company apparently they can give instant refunds back onto a card!!!!
  • I to have found this morning that the LOAN CENTRE/CORNWALL COLLECTIONS have taken £47.50 from my account.

    I have emailed the loan centre requesting an immediate refund under under the Financial Services (Distance Marketing) Regulations 2004 blah blah blah.....

    I am livid!! :mad:

    I need that money by Friday :(
