    You have 2 contracts. One with your network, and the cashback one with s3g.

    They are separate, and the one going bad doesn't affect the other which is binding.

    Bob Fuller is no longer the CEO at 3 - Kevin Russell took over early last year. If you complain to the executive office and escalate your complaint, 3 will look into your claim and assist you in recovering your cashback. You could call them on 08707 330295. With the focus from Ofcom being such a priority with this issue all complaints will be taken seriously and be dealt with accordingly until the network can prove to Ofcom the case is closed (to the customers satisfaction) hope this helps.
    The way to go. However, there is no point in ranting and raving to "3", or any other provider, because, legally, they have no obligation to help.
    I spoke to "3" and without much hassle they cleared the last cashback from my previous contract and two thirds of the cashback due on my current one. The nice thing is that, even though I have lost some money, I had not made the first claim on my new contract and will not have to.:T
    Whoever your provider is keep your cool and you might be surprised what they will do.:D

    Thank you - I have just spoken to a lovely Scottish man in 3 Chief Execs who gave me the Otelo phone no so that I can raise a case (as 3 cannot do anything from that office without a case number).

    So my advise to everyone is:
    • firstly speak to the normal 3 customer service and log complaint.
    • give them the 28 days they say it takes to investigate.
    • if no luck after chasing at 28 days ring otelo (0845 0501614). they will give you a case number (but will not get involved as your complaint is less than 3 months old).
    • ring chief execs on 08707 330295 and give them the otelo reference no. they will log your case and deal with it.
    Hopefully I should know the outcome by the end of the week.:T

    I thought I would just take a quick look at my MCOL claim and apparently Simply 3G are now going to defend it? How can they defend something if they have gone bust?

    Do I need to do anything? Do I need to withdraw my claim? Status has gone from acknowledged to defend since Friday. Surely if they are bust neither of us stand to benefit.

  • Mine was the same Sarah, so I rang MCOL today who told me that the liquidators had been in touch with them yesterday thus (as we already know) there is little point continuing the claim.

    I tried to email the liquidators but my email keeps being returned as 'undeliverable'. (Not sure if it's my AVG being over-zealous or what).

    I wanted to make a request that when the assets (if any) of Simply3g are known, that we get to know this too.

    And in addition - how these are being distributed amongst creditors and (if we're lucky) customers of Simply3g.

    Are we entitled to know?

    Also - (more questions which won;'t get our money back but still make me wonder...) - why are Simply3g now in Scotland when they were Surrey based?

    Is insolvency law different in Scotland?

    How do we know there have been no offences of fraud? (Otherwise why are they hiding across the border in Scotland and now being wound up there?)

  • There is supposed to be a large article in Next Thursday's, 14th Daily Mirror with regard to Mobile Phones and Cash-Back.

    May be worth a read.....

    Also, please make a complaint to Ofcom, as this and many other companies have still been allowed to Connect new customers, whilst it has been known that they are in difficulties.

    If the Networks will not help them in times of difficulties, they should act swiftly to stop them misleading new customers into taking out new contracts.
