DCFC - you are bothered about someone talking then admit you drive and send texts! I suppose you also drive after having a couple of bottles of wine too? Effect on drivers of both is the same - I've done the tests on a simulator and it is frightening how quickly a moment of inattention can cause a pile up.

I do advise you not to ever have an accident which injures someone. The police will check your phone records and if it can be shown you have used it at any point when you were driving before the accident (even if using it wasn't a factor in the accident) you may spend some time at Her Majesty's pleasure.

would this be acceptable to the police, not that i would attempt to take a picture whilst driving as it wouldnt be worth it

Exactly, would this be acceptable if a passenger took the photo?

The reason I ask, a car was following us on a dual carriageway at 50mph the other week, weaving and generally slowing/speeding. I realised he was on his phone (OH was driving) so made a show of photographing him on my mobile through the back window hoping he would think it was admissible evidence.

Anyway, he saw me take the pic, phone went down so job done, but I did wonder after if I could have sent the photo in somewhere.

Im guessing theres nothing I can do here but if i witness a driver talking on her mobile is there anything I can do, im 100% certain she was on her phone as she drove past me on the roundabout as i was waiting to enter the roundabout and you could see her right elbow was on the right hand door,

I could report 100++ drivers a day for some breach of the law by just standing at our lane end.

Reminds me years ago we had an old duffer colonel who had moaned to the police about speeding in the village ..........guess who was one of the first they nicked when the put in the speed trap he demanded!
