They can not sent a bailiff round to enter your property wihout a court warrent. To get a court warrent they need to take you to court first and for a judge to agree you owe the amount and for you to default on any amount the judge says you owe!
This company is the pits. Fife trading standards have many complaints about them.0 -
ggggrrrr.... i have to get this off my chest before i burst! has anyone on here had any dealings with a debt recovery company called 'mckenzie hall'? I swear to god ive never dealt with such rude and nasty people in my life. Ok, so I owe some money on a credit card, but there really is no need for them to talk to me like im a piece of !!!!. I rang them earlier cause they'd left a message on my answer phone demanding that i ring them back. The man on the phone talked me through my options for repayment, and then told me i had two choices, either 'let them pass on my details and be taken to court' or pay them £700. When i explained that there was simply no way i could get my hands on that amount of money, he said to me 'are you on benefits?' when i replied yes, he said 'do you have kids then?' in such a patronising tone that he made me feel guilty for having reproduced. after id answered yes, i have a son, he said to me 'havent you bothered to get a part time job or anything?', when i told him, no, i havent, he just said to me 'well, we can check with the inland revenue and prove if you're lying' and then he hung up on me! I swear that i dont think ive ever been made to feel so crap in my life! *and breathe*
I have had dealings with this company as well, but in my case its with regards to a previous council tenant that is in debt with them. I have been in the property now for 5 years and on a regular basis i have these people sending threatening letters, phone calls etc.. and then they have the nerve to shout and threaten me when i call them to say this person does not live at my address anymore!!! they are rude, nasty people so i thought i would be nasty with them if they wanted to play it that way, i contacted my local citizens advice who have sent a letter to them on my behalf. RESULT AT LAST i havent received a letter or phone call from them in about 1 month now and it didnt cost me a thing. I know your situation is different but just give it a try and contact them to see if they can help like they did for me.0 -

I am about to circulate the "time served" letter to the debt collection agencies which are trying to prise old debts out of me, but there is one which I am not totally certain would qualify.
Because of the way some of the DCA's write their letters I'm not sure which it would be, although there are some I know it would not be, but I know that we are within a couple of months of the 6 years being up for all of them.
I have just started receiving unlimited phonecalls from McKenzie Hall over the past few days, although I don't appear to have received anything from them in writing.
Can anyone explain for me the difference regarding the situation in England and Scotland ? I see that "time lapsed" is 6 years in England, but only 5 years in Scotland.
Is this relevant to where one lived at the time of entering into the agreement, where one lives now, where the company was based when you took out the debt with them, or where the DCA is based ?

A newbie and one of the many who are harrassed by McKenzieHall, ActivKapital, Fenton Cooper, et al. The worst, by far, are McKenzieHall, they are rude, inconsiderate and how the hell they sleep at night I do not know. My debts are handled by a debt company and have been for donkeys years, since I was retired from work after two heart attacks and obviously had a huge defecit in income. They are all receiving payments, but they still insist on phoning or leaving stupid BT messages and asking they are paid in full. They usually ask why the debt hasn't been paid in full, "well, you work it out McKenzie, I don't have the income, I am on my last legs half the time, not that you are bothered about another persons state of health and I am more interested in staying alive than worrying if your payment of £1 has arrived on the right date" then I put the phone down. Sometimes they say, "we will start proceedings then" ok, do so, I will bring my cardiologist with me and he will rip you to shreds for causing me undue stress and anxiety"
These debts are well over 10 years old and some have cleared off, hoorah, but the rest will be paid until I am pushing daisies. If I understood the statute barred status properly I would throw that at them. Anyway, rant over, off to lay in a darkened room.0 -

if they have a phone number they always phone up and ask for people
using your your fist name beware they make you think there friend or you
know them!

i read all the other articles, and im so glad in that im not the only one who has been treated appalingly by this company. But, what im really concerned with is, do i have to pay back this ten year old debt now? some people say that after 6 years you dont, but then others are saying that because i made contact with them, ive reopened the debt? im confused.....0
