HTC Desire Vodafone 500mb Fair Usage Policy

  • Some excellent news this morning. Ofcom advises me Vodafone is likely to be in breach of General Conditions 9.3, and Vodafone have misinterpreted Otelo's terms of reference as 11.2 would mean new customers not existing ones.

As Vodafone refuses to issue me with a deadlock letter all I need to do is wait 8 weeks then put in a complaint to Otelo who will rule on General Conditions 9.3, and Ofcom assures me if Otelo do not do this I must inform Ofcom straight away for enforcement.

Looks like we are on a winner, hang in there folks.

    Good work mate!

I spoke to OfCom yesterday as well... They were very vague but seem aware of what's going on...

I basically complained they were changing EVERYONES T&Cs and introducing a new charge without giving 30 days notice or giving people the opportunity to agree to the new conditions.

When I said the issue was across the network and not just for me, they seemed a lot more interested...

I think if everyone else could log the same call it would be very useful!

Spoke to Retentions today, had a good rant LOL. The person I spoke to seemed to be very aware of the issue of VF's data charges. Started with the "97% of customers never go over the 500mb limit" script but I easily countered that with enquiring how many of the 3% who did were Android handset users? He immediately switched tact to explaining how VF were "doubling the limit to 1Gb" for all their users to "make sure no-one ever goes over their limit" but he didn't know about T-Mobile's FUP being 3Gb or that Orange were scrapping their 750mb FUP to bring them in line with T-Mob.

In the end he couldn't really do anything but offer the 1Gb deal and as I don't really want to have to be constantly checking my usage looks like I'll be going over to T-Mob after 12 years with VF.

I've made this point before, but just think very carefully about doing that.

If you don't have home wi-fi then sure that maybe the best option, however personally after much worrying before getting it I've found that my usage on the Desire is only about 40mb a week...because during the week apart from at work/out I'm usually on wi-fi and always download apps etc on wi-fi. So I don't worry particularly about watching youtube etc over 3G because it all evens out...500mb = 125mb a wk, so if I only use 40mb a week I know I have the option of streaming over 3G etc if I need to.

Lots of us are also continuing to hassle Voda on this issue too and hopefully the rumours of a raise to 1GB will be correct. And also consider the network...I live in london and travel round the south east and have to say the speed of Voda's 3G is fairly phenomenal...it's fair to say I think that TMob is not as fast and also their network is undoubtedly slower precisely because people are free to abuse it.

Lastly if you're a customer of 12yrs you should be able to get a ridiculous deal with Voda. Phone's like the Desire through TMob direct are stupidly expensive and going through a third party you won't get the 3GB FUP. And it's only for 18mnths so just work out the comparative cost even on the basis of paying an extra £5 EVERY month for exceeding your limit.

I'm not a Voda apologist in fact I started this thread...i just don't want people to think the grass is greener because it's not always the case. But again if you want to stream radio for 7hrs a day/don't have home wi-fi/or no for certain that your usage will be well over 1GB a month then move networks. Just think carefully first.

Perhaps, we can start another thread, where we can discuss alternative contracts/services.

Feel free too, I think it's relevant though to make those points in this thread...as it is specifically about the Voda 500mb FUP.

While I appreciate what you are trying to tell us in your message, the fact remains that this thread is specifically for Vodafone 500MB FUP. What sort of performance or reliability others networks provide is a little irrelevant, isnt it ?

Sorry, I am not fighting you, I just prefer this thread to stay focused, as reading irrelevant posts eat out my internet allowance. :rotfl:

Email to Guy Laurence, watchdog, mse, bitterwallet, ofcom and otelo:
    Dear Mr Laurence,

After a recent contract dispute in which I believe Vodafone acted illegally and immorally, I sent a cancellation letter (attached) to Vodafone along with a cheque, both of which clearly stated the cheque to be in full and final settlement of my account.

Vodafone accepted this cancellation letter by cashing that cheque.

I have since received a new bill from Vodafone attempting to charge me an extra £5.04. As my cheque was cashed and included payment for the 30 day cancellation notice period (there were no additional charges to pay), my agreement with Vodafone has now ended and under absolutely no circumstances will I be making further payments to Vodafone.

As your customer service team is completely unable or unwilling to respond to my previous two emails in a sensible and coherent way, I am now writing to you directly to have this issue resolved.

Below, for your information, you will see the recent correspondence I have had with your "customer services" team. As I am sure you will notice, it is completely unhelpful and fails to address the issue at hand (the issue being that you have already accepted my cancellation by cashing a cheque clearly marked as being in full and final settlement of my account).

As this is the fourth time I have had to contact Vodafone, I will take your next response to be your final position on the matter and at this point, should the matter not be resolved, I will lodge a formal complaint with Otelo.

Finally, as a customer that was fortunate enough to hear about the proposed changes in advanced of them being made, I want to make clear how absolutely appalling I find it that Vodafone is hiding behind ambiguity to deny making changes to the terms of a contract and my complete disbelief that such a large company would openly admit to introducing new charges without consulting the majority of their user base. I hope for all of the users you have failed to inform that Ofcom intervenes.

    Yours sincerely

And I take your point, but I would argue it is indeed relevant as people are rightly using this thread to consider their options after changes to the 500mb policy.

Plus (sry to be childish but hey it's fun and I'm bored at work) you posted this earlier in the thread :rotfl:

I have just been to T-Mobile and there are loads of (Sim only) deals with "unlimited internet" 3gb fup for £20. Ofcourse, you do get 900 minutes, 500 texts etc etc along the way!
