    I would also like to wade in on the whole '3% of users go over the limit'. I actually added the internet pack on my old tariff with a SE C905. It was such a pain to actually use internet, that I very rarely used it. Didn't bother with f/book updates etc. Data consumption rarely exceeded 1MB ... The Desire is a COMPLETELY different kettle of fish.

    Tom, another question:

    All I want answering is 1 question. I don't want any 'we will contact you to discuss' I just wait a straight answer.

    My question:

    if I continully go over my allowance for the next 3,4,5 months will I be charged and will it be at the rate Ive been told of £5 per 500mb?

    If the answer is no:
    what is the difference to how it is now then?

    If the answer is yes:
    can you call me so I can cancel contract under clause 11.2

    Actually I do think that a blanket limit of 500MB is not appropriate. As far as I can see the actual text in the terms and conditions is this:
    27. All Vodafone services offered free or under unlimited subscription are subject to our Fair Use Policy. If, in the reasonable opinion of Vodafone, your use is excessive, we may ask you to moderate your usage. If, after we have asked you to moderate your usage, you fail to do so, we reserve the right to:

    (a) charge you for the excessive element of your usage at your price plan's standard rate;
    (b) throttle your usage; or
    (c) suspend or terminate your service in accordance with your airtime terms and conditions.
    There is no specific limit set there of course. So it's about judging what can "reasonably" be judged as "excessive", and if you are going to judge "reasonable" usage you need to compare like with like, i.e. phones that have the same capabilities and will have similar demands in their out-of-the box state. So lumping all "mobile internet" users together is not appropriate.

    So for example, If most of the new smartphone users (such as the HTC Desire), are using significantly higher than the rest of the mobile internet subscribers, then that is not excessive, it is normal usage for that phone. That breakdown of usage information is not being provided to us of course, just a notional figure of 3% across all "mobile internet" users.

    I already pay £35 a month. I cant afford extra £5 charges and this was not the case when I signed up to Vodafone in January.

    Sorry but you did agree to it when you signed up. Vodafone have *always* had a fair use clause of 500MB you just never got charged for it.

    Unfortunatly many people seen to forget that they *DID* agree to a fair use limit, it's always been there, and now thats defined are being vocal about it.

    Errr, we agreed to unlimited data with a fair use limit... Not a 500mb cap which is effectively what they're doing...

  • NO i agreed to a fair usage policy which did not have a cap at 500MB and £5 per 500mb thereafter. That has changed the agreement of my contract. No?

    Why the 10% mention by Vodafone then?

    I feel quite sorry for Tom. He's in the situation of having to be a mouthpiece to Vodafone. He's on the frontline able only to answer as he is told (i suspect) and is unlikely to have any proper influence on policy.

    Mistakes like the wording of his post this morning are totally understandable - subject to human error. Confirming points relevant to every single Vodafoe customer however should be written in stone.

    It's ludicrous that on such a hot potato issue like this possible change that customers are being given different answers in different places. The lack of consistency is astonishing.

    I've been in places where a new policy is brought in and it is made clear to staff - the last thing a reputable firm wants is this kind of basic inconsistency and minunderstanding as it could cost them money.

    1) He's being paid... We're not...
    2) He chooses to lie to us... If my manager told me to say something to someone I knew was either a complete lie or completely unfair... I'd tell my manager exactly where to go.

    Edit: If he ain't lying, he's thick as **** and shouldn't be put in a position of dealing with this issue, either way, I don't care much for him.
