A quick followup reply from my message to Vodafone today.
Good Afternoon xx Thanks for your email. We will be contacting all customers regarding the Out Of Bundle Charging who are able to cancel their accounts before the close of Business tomorrow. me and the wife both got a text but we have probably never ever gone over the 500mb fup
we only started using the net on our phones a few months ago
got my pac and i am off too t mobile - 10 pounds a month 600 mins 500 texts unlimited landline calls and 3gb on a 12 month contract :-)0 -

Am I the only one here getting differing tales about this from the "helpline" staff:
I have so far had:
"It isn't £5 it is 50p per megabyte"
"It is 25p per 100 megabyte"
"The £5 charge isn't for internet usage it is for picture messaging"
"It is an average of usage from the last 3 bills then you can cancel"
"It is the value of usage in the last bill then you can cancel"
"£5 isn't more than 10% of the £35 monthly subscription so you cannot cancel" (clearly basic arithmetic isn't part of Vodafone's employee criteria)
"I would like to discuss the fothecoming over limit fees" --- SILENCE - Line goes dead.
"You have not had any charges for Internet usage since your contract started so you cannot cancel" (I thought the 500MB was "free" - without charge)???
"You have not gone over your text fair usage of 3,000 texts so that is why you have not been charged £5". (I am talking about Internet Usage).
Jeeeez - what a shower of horse poop.0 -
Does anyone know how much this would cost to take to court?
Also how to go about it? Would this be small claims? Or some other court?
The grounds for this in my case is Vodafone's refusal to agree to terminate the contract having breached clause 7(a) failing to provide me with 7 or 30 days notice as specified.
Basically getting a court to enforce termination.0 -
Hold on, before we go to the courts we all need to remember something. As of today, no-one is actually at a detriment to the service received or the charging. Tomorrow may literally be a different story with it being the first day of charging, but as of today there are no grounds to take this to court YET.
When tomorrow comes I suggest everyone tries again to cancel, yet this time use the tact 'today you have imposed a new charge on me'. See what happens then, I think anyone they have refused up to, and including today, they are chancing their arm the person will give up and accept it.
If they won't allow cancellation tomorrow then wait until you are actually charged then as soon as you get the bill which includes the new charge that is the other notice required to cancel. It is only after this point you should consider the courts.
I have said this before and I will stress it again as it is really important. Vodafone will compare the month you are charged with the previous months' use. If during the previous month you used less than 500mb they will argue it is your use that caused the increase in your bill and you may be on dicey grounds getting out hassle free. If you have not already done so, today is the last chance to use over 500mb data. Then from now on until you are charged you must use over the data cap. I can just see it now, people use over 500mb this month, they use 499mb next month, then the month after they use 501mb and get charged. Voda will say 'aha but you only used 499 last month, this is your fault, you cannot cancel'.
It does seem a bit perverse you have to ensure you abuse the cap in order to cancel but that is my understanding of it.0 -

i found that the call centre staff - either UK based or otherwise - are pretty much un-aware that this is happening, or have at least been trained to act dumb about it. Call centre supervisors and managers are about the same.
Your best bet wtih the call centre is to get them to look at the eforum anouncement - http://forum.vodafone.co.uk/forum-53/announcement-137-updated-24082010-mobile-internet-charging/ - for most this will be the first they've heard of it. i found that IF they went and read this anouncement they would agree i should be released but refused to do anything about ti until they got official notification. Otherwise i would end up in an arguement about what a FUP actually is.
If you have sent your letter in (signed for!) then i would wait for a couple days for a phone call before chasing it up and stressing out any more about it. It seems there is a very small team dealing with it (possibly just one bloke by the name of Andrew!) so may take time to get around to dealing with your complaint.The difference between genius and stupidity is that genius has its limits0 -
