    There's an update on Bitterwallet about this...

    http://www.bitterwallet.com/vodafone-cancels-its-fair-usage-policy-from-1-october-so-can-you-cancel-your-vodafone-contract/33934

    Apparently, if you've been going over the limit, they think you can cancel without waiting for the holy text from Vodafone.

    *edit* they're also going to post an updated letter template some time tomorrow.

    Don't know how they can say that as it is the text that leads to the issue with section 11b. Without it we have no justification for cancelling as officially the eforums are not a notification of the charge.

    I will be giving my 30 days notice and am not really concerned if I don't get a reply from them. My problem is I have more than 1 contract with them so I cannot simply cancel my direct debit and await their argument (if any) as to why I haven't paid them as I need to keep the contract I still want fully paid for. How do I just pay for the one contract bill or will VF refuse payment citing it's only a partial payment as the one I'm refusing to pay for is counted in the total bill amount?
  • Having read through all the available information on this topic, I am now failing to understand how Vodafone can still claim this a valid FUP, rather than a hard cap. I have posted the following on the VF forum asking for clarification.... what's the betting it gets deleted or closed before a response is posted?

    I know there is a big thread discussing certain aspects of the introduction of new charges, but the fact that mods are no longer responding to that topic warrants this being a new thread.

    Can you please explain how, after 1st October, the 500MB FUP is going to be any different to a 500MB hard cap? As far as I can tell from 1st October, as soon as you exceed 500MB of usage in any given billing month then you will be charged.

    When the introduction of these new charges was first announced back in May it was explained that a user would receive warnings over a period of at least two months before any additional charges were applied. I can understand that being termed a FUP. However, with the new policy of blanket charging, I struggle to understand how this can still be termed a FUP. According to DaveN_Vodafone in his post (taken from here) Vodafone still believe that this is a FUP.
    Previously we reserved the right to charge customers exceeding the FUP, however we did not actually do so. The only change is that we are now actively monitoring this FUP.

    I would appreciate a response to this question, rather than just having the thread closed and being referred to another, only slightly related, discussion.

    Well, that took all of 7 mins for 'Fast_Response' to close my thread without providing an answer!
  • In all honesty, I'm amazed they haven't closed the main forum thread about this long ago. Nobody from Vodafone has posted in there for days as far as I can recall, and it seems to have turned into one long list of complaints about the utter incompetence of Vodafone. NOT good publicicity, is it, Mr Vodafone?
  • The latest instalment in my saga is now on the Voda board:

    http://forum.vodafone.co.uk/topic/71647-mobile-internet-over-fup-limit-charges-are-coming/page__st__260__p__471907&#entry471907

    Long story short, I called for an update, they have no update but they also have no record of sending me the text mentioning £5, they know nothing about clause 11.2, and as such if I have received the text in question I have to visit my nearest Vodafone store to show them my phone!

    I was fortunately recording that call and I have sent the Director's office a copy of the call. I did make it clear during the call it was being recorded, so the point in the call where that is clear onwards can be made available to third parties legally according to the various laws (mainly RIPA, DPA and LBP regulations) I believe I'll be free to make this recording available to whoever I like so watch this space as a lack of results could mean I publish that call along with all the other stuff Vodafone have been sent that leads up this unmitigated disaster.

    What a load of !!!!!!!!. Incompetent staff as usual.

    Wifi is not included in the 500mb. If you connect to your home wifi which you pay for seperately to your ISP, how can vodafone tell you how much to use?
  • I've now received "From Vodafone: To let you know you're nearly at the end of your monthly data allowance of 500MB. If you need to use additional data there will be a charge of £5 incVAT per 500MB, however we won't start charging until 1 October 2010. To stop these alerts, text STOP to 40506"

    I think my best option is just to email back to Lee on the Vodafone Web team who i was last dealing with, and who emailed me this previously;

    "
    Further to our conversation on 3rd June.
    As discussed, I can confirm that as of 1st June we will be notifying customer via a free SMS alert when they're approaching the upper level of their data allowance. This process will be conducted over a period of months and only in the event that a customer has continued received several such alerts will we then contact them to discuss their options moving forward.
    In the event that additional data charges are billed a customer may be able to cancel their agreement with thirty days notice should the charges in question result in a 10% or more from your previous bill and the increase can be established as being the direct result of the additional data charges.
    "

    As such i have emailed him asking for confirmation of the updated announcement at the following link;

    http://forum.vodafone.co.uk/forum-53/announcement-137-updated-24082010-mobile-internet-charging/

    I have requested my PAC, informed them that my usual bill of £17.50 a month will be increased by more than 10% should a £5 charge be applied to it, and that i want to terminate. In fact for the last three months i have effectively not been charged as i have been given money back on my account for all the cockups that have happened since i took out my contract in January.

    I will be leaving Vodafone, and very much doubt i'll be going back. Looks like i'll be going for T-Mobile, either SIM Only, but possibly one of the bargain deals available for an HTC Desire.

    Might stick with SIM only for the moment and wait for new handsets to come out before signing up again.
