  • Ladies i need your help!!

    Oh has put in his paternity leave request and he is being refused on the basis that my 15th week started on the 12/05 and they didnt receive the letter untiul the 14/05 due to royal mail being slow it was posted on 10/06 by recorded delivery.

    Now the business link website states that notification has to given by the end of the 15th week before the baby is due so if im due on the 25/08 i calculate that i was 25wks pregnant on the 12/05 which would be the start of my 15th week so the latest they could receive the paperwork is the 18/05 which would be the last day of my 15th week. Now am i right or ami reading that completely wrong ?????

    Hi, I haven't worked out the dates but I should think receiving it anytime during your 15th week would be ok?? It sounds very harsh to me!! Has your OH spoken to the HR dept and informed them it was posted 10/05 recorded for them to receive it on 11/05? Can his manager have a word?? Are they an awful company normally??

If you tell your employer and then later want to change the start date for your Paternity Leave (or the amount of Leave you want to take), you must give your employer 28 days notice - or if this is not ‘reasonably practicable’, as soon as it is 'reasonably practicable'.


    going off that I'd say so long as you told them during the 15th week before the due date(at the latest) then you should be covered and they're being @rses about it!

    at least 15 weeks before the beginning of the week when the baby's due

    Which sounds like its not uptill the end of the 15th week, its all so hard to read, where has the plain english gone. I hope you can sort it though it does seem really harsh for the sake of knowing a couple of days earlier.

    Anyway goes back to lurking lol

    Xmas... from my calculations week 25 ended on the 12th so his work would of needed to know by this date BUT surely a few days out doesn't matter anyway... how silly!!!

    EDIT: Forget the above... cos I'm now totally confused about what week I am!!!

    And what I don't get is that DH's work want to know what 2 weeks he wants off (and I'm sure it's the same with others)... but how the bloody hell are we supposed to know exactly when bubs will arrive??? Babies can arrive weeks early... or if he books off the 2 weeks after due date bubs could arrive at the end of those 2 weeks!!

    Well ive just called acas and they say government guidelines state the end of the 15th week so he should still be entitled. To be honest the company are complete a r s e s with anything like this and will always try and weasel out of it if they can. They tried it last time until someone in the back office piped up that the documents had been received in plenty of time which is why i insisted that he send the form in recorded delivery so we could prove they had received it. I tell you something though I could swing for him right now i told him 5 weeks ago to get this done and he faffed about if it wasnt for the fact that i need him here to begin with i would make him go to flaming work it would be his own fault then :-(

    Smartie if you go from the 12/05 to the 25/08 there is a full 15weeks so the start of the 15th week is the 12th making the end 18/05 so as long as they received it before the 19/05 which is the start of the 14th weeks we should be ok .

    Your Oh doesnt have to give dates just provisional two weeks from your due date if baby comes early or late the paternity leave starts from that date regardless:-)

    Don't worry... I was on a silly site that gave confusing dates!!:o

    His work have made it sound like those WILL be the weeks he'll have off!! We're not too worried as work loves him so much so he's gonna take whatever weeks he wants off and he's knows they won't do much about it;)

    Dont know if this will help anyone else ive just found this calculator which gives exact dates for notices to be in by. I would advise you not pull a Mr xmaslolly though and get it in sooner rather than later http://www.employmentrights.co.uk/

    According to that as the weeks are worked out strangley from the sunday to the saturday his last date to have his form in by was the 15/05 so it arrived at the office on the 14th so they can go jump and he is entitled :-)

    Smartie i wish my Oh place was that good he gets commendations off them all the time he is a really good employee they just dont like people having time off as they have to ship in cover from other parts of the country. Up until recently they had to have 3 months notice of any holiday he wanted to take this has now been brought down to the usual 2 weeks :-(

    Oooh I had completely forgotten about sorting oh's paternity leave - thanks for the reminder ladies - according to that website we have to sort it before 5th June. I'll give oh a reminder tonight.
    I'm at mw next week when I'll be 23+5 (for my 24 week check) - I hope she gives me my matb1 as I need to hand that in soon.

    My wound from my appendectomy isn't healing :( so now the nurse has to come everyday and pack it - which makes me feel ill! Don't think it helps that the wound is on my tummy - which is expanding all the time.

    x mas that website is fantastic, much clearer with a calculator. So my OH needs his in by 28th august, does seem really early. I'm gonna have him book the 2 weeks before my due date off as I tend to have mine early by c-section.
