    Good news Mikon :T, but this sums up my feelings re. different depts not communicating and that ultimately they will try anything to get money out of you. Imagine if you were vulnerable, then they may have scared you into paying them an amount you could scarcely afford.

    As far as I'm aware it shouldn't matter at all, they will charge you for being over the limit, but only up until you start the DMP. PP

    They are still charging me for being over the limit and I've been on mt DMP since April hence me worrying about a default letter today. I'm going to phone PayPlan tomorrow.

    I've had the same letter - but my date was 10th June and my amount to be paid was £458.
    They initally refused dmp proposal but did stop interest. I did not know this was for a period of 3 months (which I was told yesterday it was)
    Statement I received yesterday had £100 interest on it so I phoned - very difficult to understand call but basically they seemed to say they would only accept a payment at 2.5% of the outsatnding debt to stop interest, so pretty much the minimum so helpful:mad:. I asked if that meant they would be passing me to DCA they said yes -I asked if that was their policy - they said yes, but I found it hard to understand them, I assume they had the same pobs with me so who knows.
    Phoned CCCS after they said we just carry on sending the payments and hsbc usually pass to dca. So lets hope thats what happens as it seems to be a good thing! Will let you know how they choose to mangle me as I'm for the mangle first!

    My sentiments exactly. I just wonder how many people break at this point or at the point of receiving a default notice. Its all about stain power and being able to stand your ground. They cannot have what you haven't got.

    I'll phone PP to tell them tomorrow but the bit that worries me is that the letter says:
    "If you have difficulty in paying any sum owing under this agreement or taking any other action required by this notice, you can apply to the court which may make an order allowing you or any surety more time"

    Did you get this as well?

    I know they did say in the phone calls that they would accept £62 instead of £43 a month to stop interest but that's just scare tactics to squeeze every last amount out of me before going to a DCA I guess!

    Could some tell me where the savings account with pots is? I am out of control with the little spending money I have:(

    I had to go back to the outlet shopping centre I was at last week as I left a bag behind and accidently spent £40 in the Estee Lauder brands shop:eek:

    I have had the same problem with Argos they accepted my DMP payment of £8 per month but then sent a Default Notice requesting £30 to clear the outstanding debt similar wording to yours. I rang them and was informed just ignore the Default Notice it is computer generated and we are legally required to send you it. My account is marked as DMP. The Default Notice will be registered with credit rating companies and prevent me from getting credit for 6yrs but who wants credit.

    Try not to worry it is part of the process. Most companies who refuse the DMP offer will refer to DCA who will stop charges and freeze interest so it is to your advantage for it to go to DCA as for court they would not go down this route as the court would rule that you have made an offer and they would also have to produce as evidence the original Credit Agreement which may be unenforceable.

    Remember they cannot have what you have not got and you are addressing your debt and being fair to all your creditors. Please try not to worry I know its easier said than done but I am speaking from experience and I can tell you it will get easier and you will learn how to play the game.

    In Recent days there seems to be alot of talk about Default Notices.

    What I would like to start is a list of who has rec'd a Default Notice from who and what action they took if any. It might help some people who receive their first Default Notice and ease there worries.

    Here goes

    Argos - Accepted DMP contacted Argos ignore computer generated

    Barclays Bank - Just filed no action taken.

    Please add your experiences to help others.
