I agree. While the highway code is not the law, ignoring it can be construed by the police as driving without due care.
No there are actually specific laws in the highway code. They are denoted by sentences such as "You MUST blah blah", "You MUST NOT blah blah".

Nobody is making a personal interpretation, at least I'm not! And I know what the rules are too. But nowhere in the Highway Code does it say you can't ask whether alternative may work, on an internet forum, which is I believe what I am doing.
It matters not really to me, as generally, when I drive up this particular stretch of motorway, I notice that people tend to spread out anyway, and don't bother moving over to the left, unless they have to.0 -

If the left hand lane is congested and all the others are empty, it suggest that there is a problem at the start of the congestion or that the approaching slip road.
Logic says that if you want to pass this congestion you would be travelling faster than the congested left lane, and have no desire to exit at the approaching junction. Therefore yes you would pass on the right.
If you were to "spread out" as you suggest, the congestion would merely spread across the remaining free lanes, and all progress along the road would be restricted.
Following a logical system keeps the traffic flowing efficiently. Accidents happen, and congestions occur, when drivers get impatient, can't follow safe control measures implemented on our roads.

Near me, the motorway changes from a two lane to a three lane road at the nearest junction. The signposts clearly state that the slip road becomes the inside lane, so there is no need to pull out into the middle lane if the inside lane is clear.
Countless slow moving drivers just pull out into the traffic in what is now the middle lane, continuing to tootle along at a slow speed when there is nothing in the new inside lane. It causes problems as drivers in the middle lane have to slow down and try and get round them, and then I'm stuck on the inside wondering if I should undertake them or just tootle along at their speed or try and get into the middle then outside lane to overtake them.
I get more irritated at the number of drivers that can't indicate at roundabouts. When you meet someone head on and they are signalling right, you have to stop to give way which is fair enough. However, then the driver sails on past you as they were really going straight on, and you're left sitting there like a muppet waiting for no reason. I know it's a trivial thing, but it really irritates me!

I think alot of the problem lies with the fact that these days (I passed my test 9 years ago so can only comment on that time) people pass their test on normal roads and there is nothing taught about motorway driving and proper etiquette. I actually believe there should be some compulsory motorway element once you have passed your test or even before. I realise that is might not be practical or safe to do this on road but something like a motorway theory test so that people are fully aware of how to drive on motorways.
I've got a fair bit of motorwar experience now but when I'd passed my test I probably would have annoyed a few people when I first started using the motorway as I wasn't experienced or aware of how you should really drive and what to do/not to do. I can see the difference in how I drive on the motorway now compared to when I first used them and that's come from experience and asking other people. I don't get flashed to move out of the way because if I see someone coming up behind faster than me I move over to the left even if it's a dual carriageway and I'm going faster than the other lane because I know I can overtake again once they're gone, if they want to go faster than me then that's fine. When I first started driving I probably wouldn't have thought like that and would have been a more immature driver.
You have to learn about tram signals for your theory which isn't exactly something everybody encounters regularly so surely there should be more stuff on motorway driving because I know there wasn't when I did my test.0 -
Oh, and one of pet motorwary hates of mine is when it's a two lane motorway and a lorry overtakes another lorry at pretty much exactly the same speed causing unnecessary queues. The second thing that really annoys me is when you're coming off the slip road to join a motorway that isn't particularly busy and there's a vehicle that could easily move to the right hand land and doesn't, it's worse when it's a long lorry because you're stuck and praying that he moves before you run out of slip road! If I can keep an eye on traffic coming down a slip road and the lane to my right (and I am not a good multi tasker at all!) then surely other road users can?0

I wasn't thinking of that bit, but yes that bit is annoying as well! I was thinking of junction 63 at Chester-le-Street.Here I go again on my own....0 -
There is a section of 4 lane on the M6 towards Coventry which I travel fairly regularly, it amazes me that the same middle lane hoggers now move over one leaving a lane either side free!!0
