i would contact ebay live chat again - reiterate what you were told the first time and get them to confirm this. ask them if you need a tracked method (more expensive) or not?
i am wondering if you could send it standard parcels with extra insurance, but as others say he/she may say they never received it. this is a tricky one.

Surely best to open a item not as described and get it in some sort of formal message what ebay believe you should do. Hopefully it's send the item back as it normally is and make sure you use tracked postage. parcel2go dhl service or something like that for 7.99 should be suitable. You have to be careful in these siturations as a strike is very easily possible although if they open payment not received I wonder if the fact they didn't use tracked postage will be hold against them.0

I don't think I'd rely on ebay refunding postage.
In your position I would email the seller and tell him the exact amount you need to send it tracked, and that you will send it as soon as you receive the money. I honestly wouldn't send it under any other circumstances.
The mistakes were his, both in terms of listing it incorrectly and sending it before payment, so the onus is on him to pay to put it right.
l would also go with the idea of disguising it as something else so he can't refuse it, and with doing a SNAD to cover yourself.Oh dear, here we go again.0 -
Never suggested that - thought it added some odd complexion to this issue. Just think the disputes don't seem to cater for this situration.0

As you had not paid for the item, could this be classed as an unwanted item that you received from a seller? In which case there is a provision within distance selling regulations, that you inform the seller/sender that their property is safe and waiting for them to come and collect, or something like that? Will have a search around google to try and find what I mean. If anybody understands what I'm talking about, please say it better than me!0

You are correct. Though not strictly unsolicited, the sender has to collect or arrange collection. Anyone who pays to send something like this back is crackers. The comment re the seller has to give return postage if the item is faulty is incorrect. You can sue for the cost, but must prove it was knowingly sent as a faulty item.
If anyone threatens you, even by email, contact the police.0 -
Not the best advice under the circumstances.
Under any circumstances if someone sends you a faulty item then the seller should pay for return postage (Paypal don't refund it as they never had it in the first place), if its a business seller then you have the right to ask for them to pay return postage before sending it back.
In the unusual circumstances of this case I would ask for return postage before sending back.
Just having seen your latest post, I'd get confirmation that Ebay are going to pay for return postage, this seems even more unusual.
I hope ebay sort this out for you and you should deffinatley not have to pay for the return postage.0 -

A cheaper alternative postage with tracking is the new drop & collect service which is part of the The home delivery network (delivers catalogue parcels normally) costs just £4.49 up to 10kg.

you take the parcel to a local store of your choice in your area (you get quite a few choices) & the reciever of the parcel collects it from a local store of their choice in their area. You get a receipt with tracking & the collector has to sign for it their end judging by what the website says so you would have proof of postage & collection.
If he doesn't collect that's his problem as you have trackable proof of postage which paypal & ebay always need when dealing with disputes.
But to be honest I would expect the postage cost from the seller 1st or let him arrange the trackable collection.
All of this is his mistake not yours so why should you have to pay anything. That's my opinion anyway.
I sell on ebay occasionally only when it's my last option as I feel ebay is trying to kick out the small sellers in favour of the business sellers to compete with places like amazon etc.
It amazes me how the sellers that give ebay £'s in ebay & paypal fee's get away with so much like re-listing banned auctions that small sellers get suspended over.
