  • Steve40....I don't think KarenX was directing her post at you. (I think it wasn't meant as a reflection on you)

BTW...Can your 2 PWC that you have paid child support privately not write a statement on your behalf which you can present to CSA or Tribunal to say that you paid 'x' amount to PWC number 1, and 'x' amount to PWC number 2? Signed and dated.

Surely that would solve your situation?

I guess the CSA needed concrete evidence that you were paying for your child/ren. Would this not do the trick?

They have had confirmation of payments from both PWC's the first pwc didnt like confirming it but she lied to the csa and was forced into a corner over trying to claim for the child after the child had left school and was expecting her own baby ..... All the payments are clearly listed in the DPA files and the PA has also been logged case closure in 2003 is also logged after the confirmation of private agreement .

Whilst we are on the subject of private agreement i was trauling through the evidences again last night when i detected a potential problem . CMEC's new body that call theselves child support options are encouraging people to head for private agreements . I have a statement in one of the CSA's submittal's to the tribunal that clearly states that the CSA can not take amounts paid under private agreements into consideration when working out child maintenance . this being so all those people opting for private agreements face persecution further down the line . i can publish the statement on here if anybody wants to see it with there own eyes ,

Anyway back to my case when i applied for tribunal hearing i found it quite strange that after a short period of time i found myself submitting evidence for 2 appeals .strange when i consider i had only appealed 1 decision because they had'nt done the investigation they claimed to have done . The CSA appeals unit made a massive balls up and went off on a tangent saying i had appealed something totally different . Then today i phoned the tribunals service to try and find out how things were progressing only to be told i now have 3 appeals lmfao !!!!!!!!!! what a bunch of morons .

so being stuck between the rock and the hard place i had to borrow some money to pay the arrears off whilst im awaiting the appeal date. i phoned dudley csa today card in hand geared up to pay the arrears and get the DEO removed from my wages . to my horror i cant because they dont know how much the arrears are ans it can take from 12 weeks upwards to work them out .

i would of expected a government tobuy a machine that is able to subtract when figures are added into it . I could hardly believe what i was being told then i remembered this is the biggest government !!!! up in the history of this country i was talking to

In was told last week they can't take the DEO off my case, because they've closed the case, as all the arrears are paid off and DD lives with me.

so don't expect 'em to do anything for you, in the eyes of many at the CSA you have 2 issues

    1) you're a NRP which makes you some sort of pond life
    2) you are male which makes you the scum of pond life
 I've paid the CSA off and stopped them taking payments:beer:
I'm stillowed some arrears by my ex

I was a NRP, now I'm a PWC, partner of a PWC, and parent of a PWC ( and very confused at times )

The biggest annoyance is that the csa have presented evidence to my MP outlining the arrears that i allegedly owe ( i can prove that i dont owe this money and will when i get to the tribunal) But when i phone up to pay the amounts so that i have enough money pay for my mortgage every month they tell me they dont know what the figure is ..
    duuuuuuuuuuuuuuuuuuhhhhhhhhhhhhhhh stupid or what ?

You for got to mention the third thing .
    3) im an honest hard working person that has always provided for my children but due to the fact they have my name and address they will persecute me to boost there statistics .

I have now been waiting since 4th may for the case to be reallocated to a case worker for a final arrears breakdown my house is being repossessed on the 24th of August . I have phoned the csa every week sometimes twice a week i have sent them a copy of the tribunals decision relating to the private agreement . Every time i phone i get told they are raising an internal issue and the case will be dealt with as a matter of urgency and that i will get a call back asap ,well surprise surprise no call backs and the case still has not been allocated to anybody i have been informed today that i have finished paying the arrears but they wont remove the deo until a breakdown has been carried out , it could take up to 20 weeks once its been allocated . Me and my family will be homeless by then .
If i had known what was going to happen as a result of a private agreement to pay for my kids i would not have done it .

nobody can say this situation is right i have done nothing wrong but am still being persecuted .

I have been to court this morning the judge has granted the repossession order and given us 42 days to vacate the property. still no word from the csa i have written to the complaints dept once again to ask where the case is held who is the case officer and for a break down of arrears . The possibility of receiving any information from the gormless muppets is looking evermore unlikely . Tho i did have a break through from one of the muppets who told me they had no right to charge me arrears for a period when a private agreement was in place and that they would be getting somebody to call me . that was the last i heard of them .

This is an absolute f.........g nightmare

I'm very sorry to read this Steve was hoping that you'd have a break through and this wouldnt happen.

Is there anyway you can get the 'granted reposession' order over turned or re investigated, or is that IT end of the road?

Feel very sorry for your circumstance Steve keep your battle wits well oiled and keep on fighting the csa, dont let this turn of events beat the fight out of you. :)

Remember this, you and your family are more than that house, just bricks n mortar is all it is at the end of the day. Although it was our choice we had to get rid of our house because we needed the money, pwc got legal aid and we had to pay couldnt pay to live and for all the court cases so got the money from the house (it was more involved than that but thats what we needed the money for), it was a hard thing to do but thats the way I looked at it:).

Thank you so much for this support . Its not the end of the road and i am already planning my next attack on the CSA through my MP iam going to quote the parts of the child support legislation that they have failed on and see if i can stir up a rats nest for the people who alledgedly investigated my case.

As for the house at least i wont have to worry about mortgage rates and upkeep of the property i will just have to pay some rent and thats it . then once the csa finally stops i will be loaded .

The judge was not interested in the reasons why we couldnt pay the mortgage all he wantewd to know was if we could afford the monthly payments and some money off the mortgage arrears as the answer was no he granted the order and wished me luck with the csa tho he did feel compensation was on the horizon but once he realised it was capped at £50 he soon changed his tune .

My passed experiences with the CSA they cause more problems than solve, we lost house, car everything after my husbands ex girl friend claimed (like 18 year ago now) they put a order on his wage left us with £100 for 4 weeks and had kids ourselves - this was for someone who was trying her best to blackmail him too and never to this date let him see the child. This has snowballed and has made not just him but us suffer.
