Hi Chriszz
No my ex doesnt have any other children so that does not apply to me, nor did I get the marital home (long story) so I didnt get that either. He would quite happily have left me and my children without a roof over our heads and has never paid for them, he now has an assessment from the CSA of a flat rate of £5 a week, but can afford two houses and to run two businesses. Needless to say the CSA is now (at last) wondering how he can do that. Would I see other children made homeless, of course not but then as a partner to an NRP neither would I ever condone him not paying for his children, as far as I am concerned I have always known that he has other children and even though we are one of the few stuck on CS1, I can go to bed at night knowing that they are housed warm and fed, even if the amount we pay would bring tears to your eyes.
The CSA are in a cleft stick though arent they? Whilst I agree they should be lifiting children out of poverty, and neither set of children should be made more important than the other, if the NRP chooses to be irresponsible and not pay for either set then how is the CSA supposed to enforce it? It is the children who ARE stuck in the middle as the innocent party because of the parents irresponsibility which was why the CSA was set up in the first place to enforce it. If we had a CSA based on the Australian system then there woul be fewer issues on both sides, liability would be transparent as a defined rate from the NRP to PWC but equally the PWC would not be allowed to use contact blocking as a tool against the NRP (if she did her maintenance would be reduced), enforcement is swift and in the unlikely event it gets before a judge (for either party) the penalties are harsh. Under that system it makes sense for both parties to comply and the children are the ones that are truly at the heart of the system, rather than being used as a pawn in the game of cat and mouse.Free/impartial debt advice: Consumer Credit Counselling Service (CCCS) | National Debtline | Find your local CAB0 -
Hi Kimitatsu,
Am glad we have ended that on a lighter note.
Its appalling to think that some things can go a miss and how yr ex can afford to run two houses and not support his own children is beyond me!!. What makes it worse is that he has no other children to support so he really is DBD.
If he is renting one out wouldnt that be classed as income (you dont have to answer to this just thinking it as am typing)
At least you have found yourself a nice husband to help you raise your children, there are some nice NRPs out there as there are PWC!.
As for CSA and child poverty, I really dont know how they are going to work that one out but all children are innocent .
Maybe our Government should take a tip from the Austrailian System, as there should be some kind of fairness for all. :T0 -
As it has been mentioned a few times in posts, can someone help me understand why the CSA reduces child poverty when the amount payable is calculated as a percentage of the NRPs income and does not bare any resemblance to the household income of where a child resides? Surely only in the situation of a high income NRP and low income PWC will the CSA's percentage based calculation ever reduce child poverty?0

they did that.
they sent a load of bigwigs off to oz to studt their system as they have a far higher compliance rate and shared care is promoted. contact blockers are penalised and lose their money, while over here, it's promoted and they are financially rewarded for it.
they got back, then totally ignored everything that they saw, then came up with csa2. :mad:NEVER ARGUE WITH AN IDIOT. THEY'LL DRAG YOU DOWN TO THEIR LEVEL AND BEAT YOU WITH EXPERIENCE.
and, please. only thank when appropriate. not to boost idiots egos.0 -

A bit like my ex who is going to court finally this year!
He has a mortgage, own business, a car worth 15k that he paid cash for, and recently just bought a second car, goes on 3 holidays per year, goes up town every weekend getting drunk and is also a professional sports player.
But he tells our case worker in criminal compliance he does not work and his girlfriend, who might I add he does not stay with, pays the mortgage on his house! And regarding the cars he has said they are his mums. Funny how they are always parked outside his house and 1 has his private plate on it that says his name! And that he plays his sport for free!
I think he thinks CSA are stupid as they have proof he owns the cars and paid for them, copies of his accounts and getting paid for his sport. But only he doesnt know that!
He is in for a big big shock when it goes to court and all this evidence is put in front of him when he has signed a declaration every 6 months stating he does not work or earn any money from any other way!!0 -
